Hours after Harrell argued that the booking photo from his arraignment on a nine-court corruption indictment should be released to the public … it was.
S.C. first district solicitor David Pascoe released Harrell’s mug shots – overturning a decision by the S.C. State Law Enforcement Division (SLED) to withhold the images from the public.
SLED is part of S.C. Gov. Nikki Haley‘s cabinet – meaning its default setting is to be as secretive and anti-transparent as possible.
And yes … this was the big news in South Carolina politics today (well, that and an issue everybody thought had been resolved fourteen years ago).
Anyway, props to Pascoe for releasing the images – which were withheld for absolutely no compelling reason (beyond Haley possibly looking to manufacture a “Harrell got special treatment” process story against her old adversary).
Haley has been outspoken in her criticism of Harrell in the wake of his indictment – which is quite curious given her own extensive history of much more egregious ethical misdeeds.

He’s in a fight to save his career and avoid jail, and the forced smile he made for the SLED photographer is part of that. He’s facing an election and doesn’t want his opponent to use a typically-sad mug shot in ads ridiculing him. But yes, he belongs behind bars.

Notice in this release you can’t see any numbers or anything identifying it as a booking photo.

Sadly, these people in government must be forced to obey the law. Power in numbers compelled the same. Never forget. There will still be other times they will refuse to respect the rights of the people. SLED still must answer as to what law they based their refusal to comply with common law. They should be only given until Friday afternoon to answer. Otherwise, complaints should be filed demanding sanctions against their legal advisors and supervisors. None of this crap with Harrell and his cronies is a matter for polite presumptions any longer. Cut them all down to size. Let them feel the wrath of the people.

SLED NEEDS TO HAVE QUALIFIED LEGAL EXPERTS REVIEW AND EDUCATED THEIR AGENTS. There Policy Appears to NOT comply with well established case law with respect to records, processing, mug shots, inter alia. SLED Chief Mark Keel is a decent man and knows how to run the department. However, SLED appears to still be suffering, perhaps, from former Chief Reginald Lloyd “policies.”

If Harrell was not read his Miranda Rights, it can be made an issue by his defense at trial.
“The photograph (of Harrell) was taken for the case file. SLED policy states that information in an open case file is not to be released,” said SLED spokesman Thom Berry.
“The case file is still considered open until the matter is heard in court. Had I released the photo, I would have been in violation of at least two agency policies on the matter and subject to potential termination,” Berry said.
“The photograph is not a mug shot, as Rep. Harrell was not arrested and booked at a detention center. His case was a direct indictment by a grand jury,” Berry said. —– Source, The State News.

SLED is not a Cabinet Agency. The Governor appoints the Chief, subject to advice and consent of the Senate. The Chief can only be discharged for cause. The heads of Cabinet Agencies serve at the pleasure of the Governor.
