National elections are ten months away, but a major power shift is coming to Washington, D.C. long before then …

Antonin Scalia, a conservative icon and the anchor of the right on the U.S. Supreme Court, is dead.

The 79-year-old Associate Justice was discovered “unresponsive” on Saturday morning after apparently dying during his sleep at a ranch in West Texas.  He had arrived at the ranch the previous evening for a private gathering – reportedly telling his friends he wasn’t feeling well, according to CNN.

Nominated to the bench by Ronald Reagan in 1986, Scalia filled the seat vacated by William Rehnquist – whom Reagan elevated to Chief Justice upon the retirement of Warren Burger.  As such, he was the longest-serving member of the court in addition to being its most conservative member.

Texas governor Greg Abbott called Scalia “an unwavering defender of our written Constitution.”

“He was the solid rock who turned away so many attempts to depart from and distort the Constitution,” Abbott said. “We mourn his passing, and we pray that his successor on the Supreme Court will take his place as a champion for the written Constitution and the rule of law.”

Abbott and others can pray all they want, but there is zero chance of that happening given that U.S. president Barack Obama will be the one making the appointment.

Obama has zero respect for the rule of law – and sadly, “Republicans” in Congress (and some on the Supreme Court) have been content to let him ride roughshod over it.

A dark day, indeed …

i never liked the direction he took the court, felt like the dynamic duo scalia and thomas were a rubber stampS for conservative agendas, but Ruth Bader Ginsburg and he were very close friends so i recon he must have been a descent man. may his children and 28 grand children find peace for their sorrow. RIP ANTON SCALIA.

Agreed. The “justices” appointed by Obummer are just what the country dose not need. The SCOTUS should be the last stop in up holding the constitution to the letter. Anything less and we get the politically correct mess we have now. This one appointment could end the bill of rights as we know it with a few rulings and they would never be brought back. The real Obummer legacy could be just that.

It does seem that I was wrong about that. It hasn’t happened in 50 years. Though theoretically possible, I don’t expect it to happen now. The Senate will come under enormous pressure to act, but I don’t think it will.

It’s a two way street. I don’t believe the President will put forth a consensus nominee, I agree the Senate will not confirm. As to who will win in this political football game, we will find out in November. Therein lies the problem, both parties will try to use it to their advantage while most of the voting populist can’t name the Chief Justice.

Scalia’s father raised his son he had instead of running off for more women and letting the boy’s grandparents do the job. Scalia and his family were proud Americans who adapted to and followed American laws. We also know everything about him because all of his records are available. My point of the immigration statement was he and his famly’s assimilation and devotion to the US.

There is no foul play here. His family rejected an autopsy so clearly they don’t think there is foul play either.

You have no evidence that he was assassinated but that isn’t going to stop you from acting like that is probably what happened. That is by definition a conspiracy theory. Your right to believe in it but that’s a bridge too far for a reasoned and rational mind to follow.

To be fair to CinC, the US Marshall’s service team brought in a local Justice of the Peace and told her that there was no evidence of foul play. The JofP did not even view the body, but declared a natural death and did not order an autopsy, which is legal in crazy-ass Texas. The family did not refuse an autopsy, rather, they did not demand one.

In such fertile soil, it is little wonder that conspiracies sprout.

I was making fun of how Republicans have no problem with obstruction as long as they are the only ones doing it. How many people here are suggesting the same thing Schumer did? They are no better than Schumer or McConnell.

We the People elect the President and the President nominates justices. Senate’s job is to confirm them. They should confirm based upon the merits of the nominee, not because they dislike who nominated them, not because it helps their party to reject them. I am against people playing politics for issues like these. These are clear cut powers in our Constitution and we need D.C. to stop playing their stupid games with constitutional powers.

It was wrong when Schumer said it. It was wrong when McConnell and the GOP candidates said it. It will be wrong for people in the future to say it. If that is their mentality then they don’t belong in D.C. That mentality poisons the well for the American people.

She took down the Confederate battle flag, which required legislation, at the first opportunity that there was for success. It is not unique to this issue that reforms require a tragedy before action is taken. She took a risk by taking the flag down. Two governors lost reelection over their efforts to remove or move the Condederate flag.

The power to confirm was given to the Senate as a check to the Executive branch’s power, not as a way for one party to obstruct another for political gain. If the Senate rejects a nominee on the grounds that it is a bad nominee, that’s their job. If they are only rejecting nominees as a way of waiting out the clock then it is a disgusting move.

I adamantly am against Hillary but if Republicans block Obama I hope she wins just because Republicans will deserve a Clinton nominee at that point. I bet they will have serious regret then.

Agree with #1! Scalia died because he was old and in bad health. I don’t believe in people getting “called home” as they call it. It is an insult to God’s plan to claim he has to decide when and where and how everything happens just to make it happen. Scalia passed away because he lived a long life and his health was deteriorating. It is sad but it happens to everyone lucky enough to live into their old age. Celebrate the fact that he had a long and accomplished life.

The Senate is under no obligation to confirm any nominee. Remember Bork and then there is the issues that John Tyler had in the 1840s. Nothing new under the sun.

President John Tyler had a particularly difficult time filling vacancies. Smith Thompson died in office December 18, 1843. His replacement, Samuel Nelson, was in office starting February 14, 1845. That’s a vacancy of 424 days. Henry Baldwin died in office April 21, 1844. His replacement, Robert Cooper, was in office starting August 4, 1846. This vacancy lasted 835 days because Tyler could not get the Senate to work with him. During Tyler’s presidency, the Senate rejected nine separate Supreme Court nominations!

If anyone had a reason to assassinate it would be Cruz. Scalia was a strict constructionist, original intent advocate. It is clear the original drafters of the Constitution would have said Cruz was ineligible to be President because he was not born on American soil. If faced with the issue I believe Scalia would have ruled against Cruz.

Oh, no. Scalia’s strict constructionism – renamed to originalism to shake off its justifying slavery and Jim Crow connections – came and went based on what ideological or partisan agenda was involved.
Since Scalia and Cruz are both extreme Christianists, Scalia may well have voted for Grandpa Munster (as opposed to Eddie Munster aka Paul Ryan)/Joe McCarthy/the devil himself aka Ted Cruz.

He can nominate anyone he wants, but that person likely won’t get approved by the Senate until after the election. The Kenyan may just hold off until the election to see if Hillary has a chance, then she can name Obama to the Court. Afterall he did teach as an adjunct professor (and everyone knows adjunct professors are the substitute teachers of college) so he must be qualified. They’ll just have to install teleprompters in the building so he’ll know what to say.

Obama won’t be nominated to the court, just won’t happen. Obama would not get confirmed due to both partisanship and his lack of experience in the judicial branch. If Hillary nominates anyone it will probably be someone from court of appeals.
