WATCHDOG SEEKS DOCUMENTS … GOVERNOR IGNORES HIS REQUEST
A prominent good government watchdog has sued S.C. governor Nikki Haley over her failure to comply with his Freedom of Information Act (FOIA) request.
Ned Sloan of Greenville, S.C. – who has fought for years on behalf of open and accountable government – submitted a FOIA last month seeking information regarding lawsuits against the scandal-scarred S.C. Department of Transportation (SCDOT).
Specifically, Sloan’s request sought information on “more than 17 lawsuits” defended with taxpayer money from the state’s Insurance Reserve Fund (IRF) – requesting that Haley’s office mail him the public records related to these cases, all of which involved “damages alleging water on road surface(s).”
Sloan sent his FOIA via certified mail on December 16. A month later, he has yet to receive a response according to his complaint (.pdf here).
According to our sources, Sloan’s FOIA is an effort to get to the bottom of several recent traffic accidents.
One of those accidents – a fatal car crash on Highway 25 in Greenville County, S.C. – was profiled in this report by Upstate, S.C. television station WYFF TV 4 (NBC – Greenville, S.C.).

I’m by no stretch a Haley supporter, but the way he addressed the certified letter leads one to believe he wanted to make it difficult. Addressing it to N.R. Haley, and the generic “1205 Pendleton St.” (which is the entire capital complex) without any reference to the Governor’s office is asking for some low-level, know-nothing (and one possibly completely unconnected to the Governor’s office, given the vast number of agencies and offices in the complex) to sign for it and not know where to send it.
Obviously the last name “Haley” would be an indication as to whom the letter was directed, but come on–Sloan could’ve easily expressly stated “Governor Nikki Haley, SC State House” and removed any doubts about it arriving at the correct destination.
But then he wouldn’t have this total non-story to share.

The dude wasn’t playing fair regarding the addressee and street address. There are 6 state employees employed at 5 different agencies (not including Nikki).

For Ned Sloan it is the 100th lawsuit. The first I remember he sued Mark Sanford for being Governor and in the National Guard at the same time. I believe Sloan lost that one. He sued about election registration laws after the legislature “fixed” the debacle that took dozens of challengers off the ballot.

There nothing wrong with it at all. I’m just pointing it out. I’m glad Sloan is willing to spend his money for accountability.
But let’s face it, there’s very few Ned Sloan’s in the state and the idea that lawsuits in government’s own courts will change anything is naive. There might be a victory here or there, but in the big picture government owns us and that’s that.

A now former high ranking official in SC State Government once told me, that his agency would intentionally ignore and/or drag out FOIA request just to annoy the person or persons who submitted the same. Under criminal statutes, that is illegal. Haley’s attorney is playing games with Sloan. He needs to be thrown on the carpet with action against his law license.

Someone needs to FOIA Nikki for how much the Taxpayers have spent on individual settlements for Illegal Cabinet Agency Personnel Actions during her tenure. I bet it is millions.
