General Assembly will elect a replacement for “retiring” chief justice Jean Toal.  At that point, current associate justice Costa Pleicones will be serving a one-year stint as chief justice – meaning there will be another election to fill his seat.

While there’s plenty of chatter about these individual races, what’s being discussed far less frequently is how the high court will change over the next few years.  There will likely be at least three new justices elected over that time frame – presenting an opportunity for major ideological evolution.

What this evolution means for our state we will see, but as a Republican I will be looking for our conservative legislature to elect judges who reflect our values.

This go-round the S.C. Judicial Merit Selection Commission (recently pilloried by this website) has selected three good candidates to stand for election to Toal’s seat: The Honorable John Cannon Few, the Honorable Ralph King Anderson, and the Honorable Bruce Williams.  All three are experienced jurists – respected by their colleagues in the bar as well as by the members of the legislature.

In short, all three would be good judges to serve on the state’s highest court.

South Carolina is a conservative Republican state.  Accordingly, we need the General Assembly to start electing conservative judges.

We need to eliminate what disgraced former Senator Robert Ford referred to as “horse trading.”  We need to have good, conservative judges cleared by the screening committee, thus eliminating the need for horse trading for judicial candidates that could not otherwise be elected.

Judges must stand on their own merit.

I had the pleasure of meeting Judge Williams and his wife recently, and he struck me as the type of person who would serve our state well. I do not know Judge Few personally, but people whose judgment I trust have told me very good things about his intelligence, temperament, and ability.  Similarly I do not know Judge Anderson personally, but he receives rave reviews from the legislators and attorneys I know.

Each of these men would make an excellent Supreme Court justice.  And while this website’s founding editor might disagree, I believe the Judicial Merit Selection Commission did an excellent job this time in sending three qualified candidates to the legislature for consideration.

I understand that judges are people. I get that part. Thanks. I would hope, though, that the decisions they make are based on more than their personal beliefs. I recall a few questions along similar lines during Sotomayer’s confirmation hearings. Are those backgrounds factors? Sure. But life experiences, etc. are certainly not chief factors and, in most cases, wouldn’t factor at all. That’s not idealistic; it’s common sense. The article suggests we need a certain type of judge. I disagree with the type that’s suggested and the logic behind it.
We also know that judges do not – or at least are not supposed to – legislate from the bench. If that’s not possible (you know, if it’s just a sweet thought), it would seem what we need is not more of the same. More of the same would do nothing to balance out the interests of, say, 60% of our state with those of the remaining 40%. So, assuming you are correct, I still stand by my point that the logic in the article is flawed.
In an ideal world, we wouldn’t even need judges. But I’m a realist. You know that, mom.

Again, your idealism is admirable. However if you look at the Supreme Court, for example, it is easy to divide the liberal judges from the conservative ones. Like most South Carolinians, I am conservative and would prefer conservative judges to liberal judges.

As someone who has worked for a large corporation, a small private owned concern and who now runs what I think is a successful small business of my own, I think I know quite a bit about economics and how business works. I survived the great recession while many on Wall Street did not; and I am job creator, 11 employees to date.

Look at your chart in that link. It is comparing very highly paid women to men (all categories averaged above $100,000) and only MBAs. The article uses 77% not 75% but none of the pay differentials in the chart are anywhere near 77%.
I should think if we are going to help women, we should focus on the lower middle class and poor.

We should focus on the middle class, but the point is women are discriminated against in pay and only one party is interested in doing anything about it. That said if as you say we should focus on the lower middle class and poor, we sure as hell don’t need to vote for Republicans as those are the very people they care absolutely nothing about.

Because the Democratic party does not support, unlimited contributions by individual to politicians, Citizens United, tax cuts for the wealthy, cuts to education, cuts to Social Security, Cuts to Medicare, cuts to health car for the poor and disabled, cuts to corporate taxes, eliminating a tax which only affects couples with a net worth of 10 million or more. The agenda of the Democratic Party is directed to making the lives of Average Americans better, and reducing the influence of money in politics. The Republican party agenda is directed at increasing the influence of money in politics and making the lives of the very rich better in the hope crumbs will fall from their plate.

But Republicans don’t stand for less government. They stand for different government. So your vote is wasted. Republicans just want government which does what they want it to do and nothing more. They stand for a system dedicated to making wealthy people richer and to hell with everyone else. Whatever size of government it takes to do that is the size they want.

Not to mention the addition of a sizable contention of racists and sexests. To paraphrase Julia Sugarbaker, “No blacks, no gays and no big mouth opinionated women.”

All the statistics for the past thirty years show that as more and more wealth is concentrated into fewer and fewer hands, the middle class becomes poorer and the poor stay poor. A government dedicated to making rich people richer does not a tide that floats all boats. A government dedicated to making the middle class richer helps both the rich and the poor. Now I don’t pretend that making the middle class richer will help the mega wealthy as much as just making the mega wealthy richer, but they will still be mega wealthy.

We do not have a progressive tax system anymore. The very wealthy pay a lesser percentage of their income and wealth in taxes than average person.

As for its not the government job to make people richer, tell that to the people who are getting rich off government. Its the job of the government to promote the general welfare. That involves a system that promotes general prosperity, We had that for most of the 20th century. But that changed in the 1980s with the implement of trickle down economic policies; and most Americans have suffered ever since.

No that is not what is called a progressive tax system. A progressive tax system is where the higher your income the higher the percentage of your income you pay in tax. You obviously do not know how this works. Different types of income are taxed at different rates. Very wealthy people, like the Koch Brothers make almost all of their income in the form of dividends and capital gains. The tax rates on that type of income is capped at 20%. That is why Mitt Romney had an effective 10% tax rate. That is why Warren Buffett pays a lower percentage of his income in taxes than his Secretary.

Further, when you take into account payroll, SS, Medicare, State and Local Taxes the disparity even becomes greater.

We do not have a progressive tax system except for people who work in regular jobs and earn a salary.

It is indeed a PROGRESSIVE INCOME TAX SYSTEM.
I have dividends and capitol gains myself, as do many other middle income people. So I do know it works. In my case, dividends and capitol gains are the result of earned money, saving money and investing money.
Keep in mind, I have already paid income tax when I earned the money. Now, years later, I decide to cash in some of my investments and I am taxed AGAIN even if the growth percentage was no more than inflation.
Jan, when you get older and decide to live off of your retirement savings, assuming you will have amassed a good bit through good investments, your bulk of income will be from dividends and capitol gains, not straight income. Also, you will need to know time requirements of sales.
As for the “mega rich”, well we could ramp up the rates on capitol gains and dividends. But these “mega rich” are a pretty smart bunch. I think they would simply move their money, citizenship or whatever it takes to hold on to their money.

When I get older??? Look this is how Republicans cooked the books against the middle class. If you are middle class and you are receiving dividend or capital gains they are almost certainly being earned in retirement accounts. IRAs, 401ks etc. Less than 1% of Americans with a net worth of 600k or less have taxable dividends and capital gains of more than $5000 outside of retirement plans. (with the exception of a sale of principal residence which is generally not taxable)

The law of course exempts dividends and capital gains earned in retirement plans from the cap. So for 99% of middle class Americans the tax cap on dividends and capital gains is meaningless. Our system is not progressive, no matter what Fox news and Republicans tells you. The wealthy do not pay a higher percentage of their income in taxes than do average Americans.

If the rich want to leave the country we should let them go so long as they promise to never set foot in the country or invest their money in this country again. We don’t need fair weather Americans.

I am not old enough to be receiving IRAs or 401ks. However, I made a few real estate investments when I was younger and I sold some of them this year. If I were required to pay the top rate of 40%, rather than the much lower long term capitol gains rate, I would be screwed. After all, I paid tax on the income I used to buy the real estate and have paid property taxes all these years. To me, the government is getting more than it’s fair share here.
Your last paragraph is telling. Hatred and anger toward the rich is seething from you. It is better for the country to KEEP rich pp here. THINK ABOUT IT.

Toal’s seat as chief justice is being filled by Pleicones. The seat being filled in early 2016 is the associate justice seat that Pleicones will vacate to become chief justice. Then there will be an election to replace him as chief. If an associate justice is elected to replace him and fill the chief justice seat, then that associate justice’s seat would be open for election in 2017.
