Why not assault? I think this “Misconduct in Office” charge is extremely vague, and could conceivably be utilized to criminalize this most trivial of offenses. It’s about as vague as this “Disturbing Schools” statute.
So let’s say you arrest a drunk Democrat who attempts to drive out of the Statehouse garage. Instead of worrying about pebbles in his shoes, and whether he fought his way out of view of the camera, and any other procedural niceties, just charge him instead with Misconduct in Office. Driving drunk is certainly misconduct, and if he’s holding an “office”, seems to meet the criterion.
Along with “disturbing schools”, “misconduct in office” is another overly vague law that needs to be re-done or perhaps revoked from our code of laws.
Maybe Nelson had a pebble in his shorts.
I’m guessing maybe lack of cooperation from the vic, but I have zero info on this.

You obviously did not do your homework. Can you imagine all the legal eagles reading this in the state think, that guy at FITS is really stupid or else he thinks everyone is as stupid as he is. I think if you lied about the sentencing term you probably lied about the women.
