ANOTHER BLACK EYE FOR SOUTH CAROLINA …
The assault of a black female high school student by a white male sheriff’s deputy is making national news – getting top billing on the Today show and other national broadcasts.
Several students took cell phone videos of the violent incident – which occurred Monday afternoon at Spring Valley High School in northeast Columbia, S.C.
Those clips show the deputy grabbing the student, flipping her out of her chair and dragging her across the floor as other students sat in silence.
The deputy who made the “arrest” – Ben Fields – has been barred from setting foot on school property pending the outcome of an investigation into the incident. Meanwhile Richland County sheriff Leon Lott – who initially defended Fields – said through a spokesman he was “very disturbed” by what he saw on the cell phone videos.
Adding fuel to the fire? Reports that Fields has been accused of using excessive force in the past – and has possibly targeted black students.
Obviously we’ll continue to follow this story as it develops …

If the SRO was in the room almost 100% chance he was called there by teacher or administrator.
If she refused commands from both the teacher / administrator to get up and leave the classroom and then refused the same directive from the officer what was the officer supposed to do?
I wish that the officer was given the same presumption of innocence / presumption he followed policy until proven otherwise that the media is affording the student by portraying her as a “victim”.
Much like the recent “clock boy” arrest I think the details that trickle out over the next few days will cast a different light on this incident.

Sometimes in the temporary absence of a good solution, the best you can and should do is no harm–regardless. Sometimes there are places you don’t go and paths you don’t take–period. Granted, a “least harm” choice is often very difficult to accept, especially when your training, culture, and ego tell you to use force.

It may or may not be that simple. How do you know she would remain in the desk as he drags it out of the room? He may have witnessed or been a party to incidents where this was tried snd only looked silly, because the party in the desk exited it as it was being dragged.
If she gets up as he starts to drag the desk, he’s won – it is far easier to take control of a standing person than one who is sitting or lying down.
I don’t know if dragging the desk would have worked – as I said, I’m armchair quarterbacking this. I do know that regardless of whether he’s exonerated or not, this will come up every time he breaths on a suspect and every time someone googles “Spring Valley High” and the next time that Lonnie Randolph, Al or Jessie need some press attention (to late on that one).

He and lots of others will receive some additional training on this soon, I’m certain. Nor did he likely envision being in a “live–film at 11:00” moment. He should have.

Not 5 minutes ago on CNN the head of National Association of School Resource Officers was saying that SC is the only state in the nation that is not a member and does its own training of SROs.
So, who knows if SC SROs get ANY school/student specific training at all or if they are just dumped in schools for one reason or another.

Often officers are taught that a fast strike is safest for both officer and perp. If he would of slowly tried to restrain her, she would of struck the officer and there might have been greater potential for injury.
The officer’s actions appear very violent, but the results are no serious injury.
Sometimes they react quickly when not nessasary. The former pro tennis player in NYC is an example. But still no serious injury.

Win Win Aviation Inc. on February 2015 sued the U.S. Department of Defense and South Carolina’s Richland County Sheriff’s Department over an alleged threatened seizure of two aircraft that the sheriff had exchanged for a Win Win plane under a 2013 contract.
In a complaint filed Thursday in Illinois federal court, the aviation company claims it inked a contract with the sheriff’s department in June 2013, agreeing to swap one of Win Win’s planes for two Sherpa aircraft the sheriff’s department obtained under the DOD’s 1033 program, which allows law enforcement agencies to acquire excess military equipment.
But now, Win Win says, the sheriff’s department has been terminated from the program and wants the Sherpa planes returned to the DOD. That request not only violates their agreement, the company alleges, but also would cause “irreparable harm [and] damage” since Win Win has pledged the Sherpas to various contracts with the U.S. military and spent “upwards of $500,000 per aircraft” on allegedly necessary modifications and upgrades.
“If any of the defendants are successful in seizing the aircraft, [Win Win] will be prevented from completing the contracts to which it has pledged the Sherpas, subjecting it to causes of action sounding in breach of contract brought by the various branches of the military,” the company says. “Furthermore … [it] will be subject to a negative review by the Commercial Airlift Review Board … [and end] access to future contracts available to air mobility command vendors for its noncompliance with the contracts.”
Richland County Sheriff Leon Lott and his department assured Win Win that the exchange was allowed under the 1033 program contract with the DOD, which allows an agency to sell some goods after at least one year of usage, according to the complaint.
Win Win claims it spent hundreds of thousands of dollars to revamp the planes, on the understanding that the company would eventually take formal control of the planes’ leases. Without the upgrades, the company alleges, it could not have lent them out for contract services.
Win Win seeks a favorable ruling on its continued use and eventual ownership of the planes and injunctive relief against the threatened seizure.
“[Win Win] does not have an adequate remedy at law or otherwise for the harm or damage threatened to be done by defendants because the totality of monetary damages is not only speculative in light of the defense of contract breach claims but, more importantly, crippling of [our] ability to function as an ongoing concern,” the company states.
Representatives for the DOD, Win Win and the sheriff’s department were not immediately available for comment Friday.
Counsel information for the U.S. and the Richland County Sheriff’s Department was not immediately available.

Based on the response from the administration and Brother Leon, Deputy Fields is still in trouble. Lott has called in the “fedral gubamint” investigators in an attempt to appear unbiased (but mostly to escape blame if the investigation determines this to be appropriate)
My guess is that she is has this culturally-based script in her head that tells her “ain’t no man gonna put his hands on me”, and “fights back” to try to stop the contact. I have spent many hours trying to advise women that assaultive and abusive behavior is unacceptable, but responding like this is too often a ticket to the ER. The guy has an even more power script in his head: “ain’t no woman gonna do that to me” and the force and consequences escalate quickly. This is in no way saying that all parties have equal responsibility for the outcome.

My high school aged son tells me about the disrespect he sees every day at AC Flora, but only in his “related arts” classes (i.e.: spanish, keyboarding, etc) where he’s in with general population. His core classes are all honors level classes. Very structured, organized and a certain decorum is followed by all the students, whether they’re black, white, latino or asian. His related arts classes sound like a zoo. Disrespectful kids talking over the teacher, playing music on their cellular phones, back talking the teacher and other similar disruptive behavior. Clearly, this disrespectful “child” was intent on the confrontation turning physical, otherwise she would have gotten out of her seat. When the officer tried to initiate the arrest, she became combative. It’s simple cause and effect. She could have easily avoided this. Instead, she escalated it and now we have yet another case of perceived police brutality and/or racial injustice.
There have actually been books and studies about the teenage brain. There was a great synopsis of the studies in Time Magazine about 15 years ago. Do some research. It’s interesting stuff.

I had a middle school principal tell me once about how he expected hormonal/teenage brain behavior from the kids he dealt with…but, that was 20 years ago when principals didn’t yet dump all their discipline problems on the SROs, who were just showing up in schools. And, perhaps, before the education college curriculum got as dumbed down as it appears to have become.
Why you would think this girl was ‘intent’ on this confrontation with a grown muscled up man becoming physical, I don’t know. But, she might have been prepared/scared that it might. When you see this cop grab her under her leg to facilitate overturning her desk – without any apparent thought that her head could crash into the floor and bust wide open – it’s obvious she was right.
I have heard nothing that this kid was assaulting anyone in this class. That means the cop overreacted.
Ignoring multiple verbal commands is going to lead her down a path. Certainly common core hasn’t dumbed her down so much so that she fails to see this coming, or maybe it has. She was likely asked by the teacher multiple times to exit the classroom, to which she apparently decided to disobey. So, enter an administrator (black man with walkie talkie on his belt) and the SRO. She most likely had a dozen chances to do the right thing.

There was a time when teachers and principals could handle students and cops were not on the grounds. I remember it, too.
Hell you used to dream of the Cops coming to peel the Principal or Coach or your parent off of you.

There was also a time when teachers could whip a student’s ass to maintain order, if necessary. This was almost always followed up with a worse ass-whooping at home, administered by the father. Those days are long gone, as are classrooms where the teacher maintains control, soon to be followed by schools snd streets where the cops maintained control because of incidents and reactions like this. Soon, you will rightfully see cops figuring out that their best bet for making it to retirement, with their reputation ,career, and freedom, intact is to do nothing or as little as possible to upset the undisciplined elements of society.

The issues a lot of these kids have that people like you complain about are exactly because they are indeed the victims of excessive, abusive corporal punishment in their homes and are, thereby, taught that reacting with violence is normal.

I understand Baltimore and other areas are reaping what they have sown, with increases in murder and other violent crimes, because the police have successfully been intimidated into not doing their jobs over just such silliness as this.

Last time I checked, Failure to Follow a Lawful Order, was still a crime in South Carolina. He told her to get up, leave, whatever it was, she refused. At that point, she’s subject to arrest. Resisting arrest is a crime. Excessive force to make an arrest is ALSO a crime. LE cannot do whatever, in the hell they want to, to arrest a person or make them leave.
The officer acted quickly by surprise, resulting in minimum force.
The deputy acted excessively, resulting in a violation of the student’s constitutional rights.

Slamming a kid in a desk on the floor to get her out of it is not ‘minimum force’.
Use of force to make an arrest is legal. Excessive force is never okay and is criminal. The LE professional should have used his training to remove her i.e. use pressure points to make her stand up, move her out with the desk or call in another SRO to help take her out of the room. The student is wrong and should be expelled and have a disturbing school charge. The deputy is wrong and should be fired and charged with assault and battery. Both persons can be wrong AND both be punished. These consequences are not mutually exclusive.
The officer was successful. She was not injured.
He failed. He used excessive force, broke the law, will lose his career, and made a teenage martyr out of the student. She’ll either drop out or go to Alternative Academy.

I remember when I was a store clerk, as a student, a black kid came in and, without any attempt at hiding, grabbed a case of beer and started for the door. I locked the doors and called the police. One white officer arrived and spent a half hour restraining the kid never hitting him once. The officer’s shins and pants were drenched with blood from the kids kicks.
That was a dangerous situation. The officer was carrying a gun which might have been grabbed in a prolonged struggle. It would have been safer for the officer to have initiatiated a surprise take down like at Spring Valley.

I spoke to the officer days later. I asked why he let the kid kick him so badly. He said, that kid could head butt me, bite me and kick me, but the only way he could get my gun and shoot me is with his hands. That was my entire focus. Restraining his hands.
But you are correct! A quick and DECISIVE maneuver such as was done by Deputy Fields would have negated the kicking AND the gun hazard.
The SRO handled this badly when he tried to pull and throw the kid out of the desk when he could have grabbed the back of it and slid it and her out the room.

This is making news because when most people watch the video they recognize excessive force when they see it, even though it’s an objective standard.
