|| By FITSNEWS || Six days ago we reported on the Federal Bureau of Investigation (FBI)’s belated admission that it screwed the pooch when conducting “Holy City Massacrer” Dylann Storm Roof‘s background check.
Under current law, the government has a three-day window to provide a valid reason why someone should not be allowed to purchase a gun – otherwise, they get to buy it.
The FBI had a valid reason why Roof shouldn’t have been allowed to buy a gun … but they apparently couldn’t put their finger on it in time.
This acknowledgement – conveniently made public the moment the Confederate flag came down – was transparent in more ways than one.
Anyway, in our coverage we made three predictions. The first being …
The government will use this as an opportunity to eliminate the three-day rule – thus making all gun sales in America contingent on federal approval, which may or may not ever come.
Guess what …
In both Washington, D.C. and Columbia, S.C., legislation is being introduced to impose precisely such a mandate. At the state level, the issue will be pushed by S.C. Rep. Beth Bernstein – who is modeling her legislation on a federal bill being introduced by U.S. Rep. Jim Clyburn.
“This is one of the most dangerous loopholes we currently have in our gun laws,” Bernstein said. “Most law-abiding citizens who purchase firearms have their background checks approved within minutes. But when someone has a criminal record, or pending charge, it may take longer for the FBI to gather all the information to determine if that person is legally authorized to buy a gun. We shouldn’t put an arbitrary three day deadline on something that could result in a deranged individual or criminal purchasing a gun. If we’re going to require a background check, we should require the background check be completed.”
Makes sense, right? Sounds like it … but not really.

Look: We completely understand if the FBI wants to take seven days – or even fourteen days – to ensure that a firearm isn’t landing in the hands of a violent criminal. We get that. And that’s important.
We also get that bureaucracies are slow. After all government employees have lots of online shopping to do. Games and music to download on their taxpayer-funded smart phones. Pictures of their kids to upload to Facebook.
So fine: Establish a seven-day or even a fourteen-day waiting period as the new standard in such cases (pending a comprehensive delineation of the offenses which are to be subjected to the rule). We’re fine with that.
Unlike an eternal, arbitrary delay … that makes sense.
But here’s the root reality all of this “arguing at the margins” ignores: More guns = Less crime. As much as the gun-snatchers on the left wish it were otherwise, the reality remains: More guns = Less crime.

I am a life long Republican but I know whereof you speak. I have this soft spot on the wall of my office where , when they do stupid things, I just beat my head. The term “herding cats” was coined about Republicans. I had a friend in the cattle business and we were talking once about cows. Even worse, if the records are screwed up it doesn’t matter if it is 3 days, months, or years. The three day rule ain’t broken, it’s the accuracy of their records that needs fixing.

True story: back in the day when I was still delivering the morning newspaper, I discovered a small briefcase at the end of a customer’s driveway. Inside were the FBI credentials and issue weapon of a local agent. Being the nice guy then that I still am today I went to the local office to discreetly return it to him.
I think he was angrier that my doing so could have exposed his carelessness than he was grateful.

A long time ago I was working construction at a new Federal Prison doing underground electrical work. I found a Bureau of Prisons key set in the sand. I showed it to my field Super and he had me go to planning meetings with him to see if we could determine who the owner was. Sure enough one of them looked like he had aged 20 years overnight so during a break we engaged in a conversation about hating losing things to give him a hint. He said he felt the same way and is always eternally grateful when people help him find things. A covert handshake returned the keys and the relief just washed over the guy. For a minute we were concerned that he would start crying. That deed was good for a case of Killian’s Red and Molson”s Ice every Friday for the next year left on the job.
Once.. and keep this totally confidential.. I saw one of the professors at school drop a bag of meth out of his pocket when he took his keys out to open a classroom door.. there wasn’t anyone around. After he went in, I went over and picked it up.

Wasn’t the actual charge a misdemeanor that would not have prevented him from purchasing a gun. Also, Funny how a president that commutes sentences for non violent drug offenders would try to use a non violent drug arrest as a way to restrict someone from possessing a weapon. Granted, This jack ass took that gun and murdered 9 people but at the time of the purchase he was no different than those people that Obama chose to unleash back in to society, except at that point his crimes weren’t near as severe.
I still hope that this guy is put to death sooner than later but the hypocrisy of the democratic party will never cease to amaze me.
Try to Know D Truth before speaking. The trespassing charge was indeed a misdemeanor, but the drug possession was a felony, and that was what was not properly processed by local and state law enforcement, preventing the FBI from denying the permit.
SLED processed it when LCSO provided the correction, to reflect CPD as the agency making the arrest. Can’t blame SLED for this one.

Some news accounts report that Dylan Roof had been arrested for felony drug possession a bit over a month before he bought a gun. Others disagree, saying the arrest was for a misdemeanor. Here’s what FBI Director James Comey said:
On April 11, Roof attempted to purchase a handgun from a store in West Columbia, South Carolina, a near suburb of Columbia. That day was a Saturday. On the next business day, April 13, an examiner in our West Virginia facility was assigned the case and began to process it.
Her initial check of Roof’s criminal history showed that he had been arrested in South Carolina March 1 on a felony drug charge. This charge alone is not enough to deny proceeding with the transaction. As a result, this charge required further inquiry of two potential reasons to deny the transaction. First, the person could have been convicted of a felony since the arrest. Second, the underlying facts of the arrest could show the person to be an unlawful drug user or addict.
So had Roof been arrested on a felony drug charge or not? I did some digging about that, and about federal drug law more generally, and here are my tentative conclusions….
Some violations of 44-53-370 are misdemeanors that carry less than 1 year. The FBI states that the charge would not have prevented the sale. Of the 2 other factors: 1) He did not have a felony conviction. 2) Even if it had been listed as a misdemeanor it would have given rise to believe that Roof was an unlawful drug user or addict.
I stand corrected on the matter of Roof being charged with a felony. His drug charge was a misdemeanor, but there was still a local error in not getting information into the background check database that would have barred his purchase.

Roof was charged earlier this year for the possession of a drug called Suboxone, a misdemeanor offense that did not meet that threshold, and so would not have barred him from making the purchase. Cut the number to 1/10, or even lower, and you still would not be safe where you cannot be armed. Criminals like the illegal in San Francisco or the POS in Charleston will ALWAYS get their hands on a gun if they want to badly enough. Gun laws only inhibit the law-abiding, who happen to be the same ones who are NOT the problem. Even in the UK, looked to by gun grabbers as a model of gunless Utopian society at its best, you can still be shot, but more often bludgeoned, stabbed, or perhaps beaten by a gang, instead. I’ll take what we have here.
All I saying that more guns does not equal less crime. Studies have shown this. NO study has shown the opposite. And really, the UK, whose murder rate is tiny compared to ours. But if a couple people or shot or someone gets beat up, they need to arm up. Yeah, that makes sense.

When South Carolina was ruled by Democrats, common folk could not carry a pistol. I remember, as a young reporter, getting caught in a fire-fight between Charleston hoods and the police. Sure wish I’d had a gun. I got one the next day.. In Savannah.
What are the murder rates in areas like Baltimore, Chicago, and New York that are controlled by democrats and have strict ant-gun laws?
First, most large cities are controlled by Democrats, so no help there. And most cities have a LOT of people crammed together, therefore are called cities. And when did NYC get lumped in? And explain, then how SC has such a high murder rate?

Sometimes it should be about correcting the problem not scapegoating an employee. If this is a widespread problem as a result of poor training or procedures then you should assign blame where it belongs and fix the problem. If this is an isolated incident involving a good employee then you treat it as such. If this is a problem employee then…….
You also have to think that the confusion in the charge could be the result of the Cola PD Officer not providing the correct information.
I’m sorry, the response should correcting the error and not crapping on the 2nd Amendment. We have Laws in place, lets enforce them correctly, this was completely preventable. The instance of crimes being committed with legally purchased weapons is very low and technically this was perpetrated with an illegal one on the fault of LE.
No issue with that but if the error occurred because of procedural problems at the jail then you correct the procedures. You do not scapegoat the employee. Read the sentencing statute for drugs in SC and figure out the proper sentence. Even if everything procedurally is perfect you don’t fire a good employee over a rare mistake just to save face. If this is a problem employee then you do what is necessary. Also, The FBI has said that this charge would not have resulted in the denial of the weapon.

Now, let’s add to this, the condition that he gets away with it, except for a mental breakdown of one of the witnesses, in which he confesses to a psychiatrist.
How do we avoid scapegoating the soldier who raped and murdered while correcting the failure of the procedures that failed him?
Show me where he could mistakenly rape a 14 year old girl, burn her body, and murder her family while he thought that he was following a proper procedure. You are comparing murder to a data entry error.
The fact is, an unverified procedure is not a procedure at all.

If the Republicans can scare the shit out of their constituents, and insist that no one is safe unless everyone is under surveillance, and that anyone who challenges authority is a terrorist, or worse, a liberal – then the common knowledge that they are corrupt and don’t allow dissent will eliminate any remaining resistance to the transfer of wealth from the middle class to the richest men in America.
Nothing enhances reliance and obedience to authority more than a fully armed population openly carrying weapons with the safety off and a bullet in the chamber… and a federal, state and city police force equipped to deal with that situation.
If not for surveillance we wouldn’t have the image that allowed Dylan Roof to be identified so quickly. This camera was placed by the church at their expense and of their own free will. The only party trying to get changes in legislation out of this is the democrats trying to extend the waiting period for firearm purchases.
