He’ll spend his life in jail with or without the death penalty and never have that chance again anyway….your argument is irrelevant.

The Colonel June 18, 2015 at 8:21 am

Tell that to Richard Matt and David Sweat, or Pee Wee Gaskins, or Paul Mania, or Michael Bozarth.

So? June 18, 2015 at 8:29 am

Alright, point made…but if we focus on the model of justice we are supposed to have in the US, where we let the occasional guilty go free to assure no one innocent is jailed(or killed) then the rare exceptions are “acceptable”.

I can’t remember the specific academic name for it justice wise right now, (it was college where I learned it) but I’m sure you know of what I’m speaking as you seem to be to educated man.

The Colonel June 18, 2015 at 8:34 am

The other day, I provided a list of guilty folks whet there was no doubt that the convicted was in fact guilty (Gaskins was on the list, his death sentence was commuted until he killed another prisoner). There is no doubt James Holmes is guilty, many, many other capital murder cases are just as cut and dried.

So? June 18, 2015 at 9:00 am

Now I know that in your mind that you are a true patriot, and I say that with no malice.

It makes sense because you’ve devoted your life to the US government-

But, that very government coudn’t even keep a lid on your security clearance information…and lost it to a rival none the less….THEN didn’t tell you about it for over a year.

Seriously, this is the institution that you want judging who should or shouldn’t die? Are you that sure that everyone convicted should die? Because the problem is, if you’re not, then you’ve decided to accept the “break a few eggs to make a omlet” notion in US justice….

The Colonel June 18, 2015 at 9:02 am

Last time I looked it was twelve of you and me making the call…

So? June 18, 2015 at 9:03 am

The problem is that the justice system/government controls the flow of information for the decision point….

GrandTango June 18, 2015 at 8:52 am

You never went to college. And it shows. LMAO!!!!!!!

The Colonel June 18, 2015 at 10:05 am

You are referring to Blackstone’s Formulation – “It is better that ten guilty persons escape than that one innocent suffer”

I don’t disagree with the notion however, in the cases where there are clear eyewitnesses and the guilty party is caught with evidence of the crime still on his person, I’m willing to risk it.

So? June 18, 2015 at 10:08 am

“You are referring to Blackstone’s Formulation”

Nah, that’s not what I was referring to… it was a mixture of law & logic. I want to say it was something along the lines of a “beta” model or something.

Anyway, from my perspective you are saying two opposite things:

“I don’t disagree with the notion”, then “I’m willing to risk it”.

The system doesn’t delineate…..that’s the problem.

The Colonel June 18, 2015 at 10:21 am

Okay, since you ignored the “…in the cases where…” clause I guess you wouldn’t see the difference.

Jame Holmes was caught at the scene of the Aurora Movie Theater massacre – there is no doubt that he was the perpetrator, evidence on his person, in his car and at his apartment clearly links him to the act. I don’t really care if he is “mentally ill” – most murderers are to one degree or another, he deserves to be put to death.

Slager probably deserves a murder charge (he’ll get manslaughter) – there is no doubt (thanks to a tape) that he shot an unarmed man, who probably posed little risk to society, in the back. I only say probably because we don’t really know all the facts about Mr. Scott, there may have been some reason for Slager to treat him as a fleeing felon (though I doubt it)

So? June 18, 2015 at 11:03 am

“Okay, since you ignored the “…in the cases where…” clause I guess you wouldn’t see the difference.”

No, I really didn’t…I addressed it by saying the current system “doesn’t delineate.”

To you and me, it’s “common sense”, but not to the justice system.

It’s a systemic problem.

Tazmaniac June 18, 2015 at 8:32 am

So? picked a crappy time for that argument. I guess National news is a thing for him.

So? June 18, 2015 at 8:35 am

Not really, it’s good he brings it up.

It’s not like everyone runs indoors every time they hear thunder. If the chance of the lightening strike go up, many people just accept that and carry on.

Tazmaniac June 18, 2015 at 8:40 am

Lightning is a phenomena of nature, only Libs think they can control that. Incarceration and Justice, or lack there of, are man made. Almost undoubted, those two asshats are going to kill while they are on the run so explain natural vs man made to the potential victims and their families.

So? June 18, 2015 at 8:42 am

Yea, but you’re not speaking to the issue me and the good Colonel are discussing…which is the death penalty.

Look, if anyone, you of all people should understand the danger of giving a mostly incompetent government & justice system control of someone actual life.

It might be different if the justice system and/or government was functional to any significant degree, but it’s not.

I understand your concern…but take a step back and look at the big picture.

Would you rather pony up for a scum bag like this rotting in a cell, or send him to the chair but know that occasional man goes that wasn’t guilty?

That’s the question you have to ask yourself, and I understand that people feel differently about it- but let’s not pretend the system doesn’t convict innocent people.

Rocky June 18, 2015 at 10:15 am

Well in this case, I would suggest to you we have the ability to set a bar. We catch this little GT and we have him visually there, on video, and without a shadow of a doubt – inject him. (Actually hanging him from a nice tree limb on the Battery would be nicer), but if it’s cloudy, there’s no direct video linking the killer on a singular murder, and it makes us feel better – he can rot in Jail. Maybe in honor of the slain State Senator – for those folks we can renovate Castle Pinkney into a rat and crab infested set of jail cells.

CorruptionInColumbia June 18, 2015 at 1:03 pm

Not necessarily. Plenty of people who received life sentences went on to commit additional murders. Some committed them in prison against guards, other staff, or other inmates. Some escaped and committed them on the outside. Still others got sentence reductions, parole, or other early releases and committed additional murders. To my knowledge, no one who actually received the death penalty went on to commit other murders, save for those who came back (reincarnated), grew up for a few years, and started down that path again.

Tjdje June 18, 2015 at 9:34 am

Rocky June 18, 2015 at 10:18 am

How many bad guys with guns you stop to date?

CorruptionInColumbia June 18, 2015 at 1:23 pm

I don’t know if they had guns or not, but on at least two occasions, three persons apparenly with ill intent towards me have been disuaded from taking whatever plan they had any further, in part, because I was armed. My late father averted what at best would likely been a bad beating by two guys who approached him in a no facilites rest stop. They approached him after walking around his parked car and commenting out loud, “looks like somebody has money”, as he stood relieving himself in the tree line. They asked if he had any money when he emerged from the woods after finished relieving himself. He replied that he did not, to which one asked what if they shook him down. Dad showed them his nickel plated .357 revolver and added his own “what if” that involved him blowing their guts across the rest area parking lot. Needless to say, they and their accomplice/lookout/driver left the rest area wiyh all due haste. Dad went home in one piece.

Paranoid Delusions June 18, 2015 at 9:24 am

Imagine yourself at a grocery store. Imagine yourself driving down the road. Imagine yourself at the mall. Imagine yourself at a movie theater. Imagine yourself at the doctor’s office. Imagine yourself in a classroom.

Most citizens imagine themselves unarmed in all of those instances because they are unarmed, every day. Please don’t assume that we are all bad citizens for not wanting a gun strapped to us 24/7/365.

Reply
CWPcarry June 18, 2015 at 9:35 am

I’m not saying you are bad, just negligent. I know you can’t carry everywhere but how many armed robberies occur at doctors offices? they happen at gas stations, pharmacys and retail store and restaurant parking lots. That’s where you should be carrying.

Negligent Is Bad Dumbass June 18, 2015 at 9:44 am

Guns require responsibility, if someone decides they don’t want to deal with that level of responsibility they are not negligent. There are a lot of bad gun owners who are negligent. We see that on the news all the time when their kid gets into their gun cabinet and shoots themselves. That is negligence. Choosing not to own a gun to eradicate that kind of risk is not negligence, it’s being a good citizen.

Bringing a gun out in public is an even higher level of responsibility, so if someone chooses they don’t want to have to worry about that responsibility they are also being a good citizen. I’d rather have a responsibly armed person than ten irresponsibly armed people.

CWP does not mean anything June 18, 2015 at 9:12 am

A single CWP holder carrying that moment could have been shot first and rendered no help to the situation at all. CWP also does not arbitrarily grant someone the right to carry into a church.

SECTION 23-31-215. Issuance of permits.

(M) A permit issued pursuant to this section does not authorize a permit holder
to carry a concealable weapon into a:

(9) church or other established religious sanctuary unless express permission is given by the appropriate church official or governing body;

Argue What? June 18, 2015 at 9:26 am

What are we arguing? That a CWP holder might not be a valiant hero, but simply another victim? Or the fact that a CWP holder does not have an explicit right to carry a gun into a church without express permission? I’m not certain you are intelligent enough to know what to argue.

CWPcarry June 18, 2015 at 9:32 am

I’m stating a fact, not arguing. If an armed citizen had been there, there is a greater possibility that it could have been beneficial. Yes, I agree anything could have gone wrong, but not much more wrong that what actually happened. CWP holders across the country have stopped violent crimes, it’s not widely reported.

Key Words June 18, 2015 at 9:38 am

Could have. Exactly. It could have also had no effect. It could also have a negative effect if the CWP holder accidentally shot someone while missing the shooter, or if the shooter shot and killed the CWP holder and took his gun as an extra weapon.

I get that a CWP holder can shoot a bad guy, but thinking that a CWP means automatic tragedy aversion is childish. If no one there wanted anything to do with having a gun on them at all times that is their choice. Demeaning people for not being gun nuts is retarded.

CWPcarry June 18, 2015 at 9:54 am

It gives an otherwise defenseless person a fighting chance. That’s all. If you choose to be defenseless, that’s up to you. no one will ever read my name in the news as being a victim..

CWPcarry June 18, 2015 at 9:28 am

It’s like this.. Get a CWP, Get armed, Get expressed permission if and where necessary, or… take the chance of being the victim of a violent crime. It’s up to you. The state has given every eligible citizen the tools to protect themselves, the police obviously are not your babysitter. Use the tools given to you or suffer the potential consequences. I feel really bad for those victims and at the same time think that they if they had taken just a tiny bit of time to protect themselves this whole tragedy could have been avoided.

Gun Nuttery June 18, 2015 at 9:35 am

So you’re saying because the people weren’t armed it’s their fault they died? As I’ve said before, having a gun doesn’t mean you win. Having a gun means you might have a shot at taking the guy out, but it also means having a shot at just ending up as another corpse on the floor anyways.

Not everyone feels like they need to carry a gun with them everywhere at every time. If you are that paranoid good for you but not every person should have a gun. Having a gun is a responsibility and if someone is willing to admit they don’t want that responsibility then good on them, they shouldn’t be shat on for admitting they don’t want to mess with guns. Get over yourself.

CWPcarry June 18, 2015 at 9:41 am

If you know any law enforcement officers, ask them this question: Have you ever investigated or are aware of a violent crime that was carried out in which the victim was armed?

Highlander June 18, 2015 at 9:46 am

CWPcarry June 18, 2015 at 9:52 am

As I stated elsewhere today, Legislators like Jay Lucas, Larry Martin, Greg Hembree, and Mike Pitts have created or kept churches as Gun Free Zones, ensuring that law abiding citizens in those venues are kept defenseless from this kind of barbaric attack. Almost 100% of these type crimes (mass shootings) take place in Gun Free Zones, and I don’t believe for one second that it is coincidence. Cruds like the one responsible don’t want to risk being interrupted In the process of running up their casualty count.

Cruds like the one who committed this atrocity can give thanks to those afore-mentioned legislators and their kind for keeping good people off balance while they (cruds) do as they please, where they please, and when they please.

Seriously, if someone is going to commit murder or mass murder, does anyone really believe another few months or even years worth of sentence will stop them from bringing a gun with which to do it?

The only ones impacted by such stupid laws are the law-abiding, and they are not a reason to worry.

Bite you? No thanks, I don’t want to catch your crazy. Have you been to Charleston recently? Just asking.

Bite Me June 18, 2015 at 9:26 am

Poor Rocky. He might not do well in jail. I think I will report him too. Anyone have the phone number to the SC FBI Field Office in Columbia?

Once Bitten Twice Shy June 18, 2015 at 9:28 am

Hmmm, didn’t answer my question about Charleston. I think we know what that means Pogo.

I think Pogo is speaking in tongues now or something, yep, he’s insane. What’s that tip line number again?

You know, even though it’s “black helicopter” shit, I really don’t doubt the Feds, across multiple agencies, watch this site-focusing on the comment section.

They’ve got tons of money to sit around and do nothing but peep on everyone here all day anyway in the name of “safety” and so that’s that.

It used to bother me, but I’ve settled in to the fact. Fuck em’.

Look at it this way Tango, at least being an @SShole isn’t illegal – else you’d already be getting corn holed.

The car the shooter was driving is a 2004 to 2007 Toyota. But the police will not say this. The photos and the emblem … its a Toyota

They’ve said it was a Hyundai Elantra – so I guess you’re judgement is questionable, or simply you’re the shooter and trying to throw people off your trail.

I guess we can start calling Pogo Dylann now.

Toyota? Nope, Hyundai. Maybe that’s why police didn’t say so quickly, because a fool opens his mouth when a wise man would keep it shut.
