FORMER SCGOP LEADER, SOCIAL MEDIA FIREBRAND CHARGED WITH CRIMINAL DOMESTIC VIOLENCE

|| By FITSNEWS ||  Sheriff’s deputies in Lexington County, S.C. have arrested former state “Republican” party executive director and social media firebrand Todd Kincannon – charging the prominent Palmetto attorney with criminal domestic violence (CDV) in the aftermath of a bizarre incident last month.

A more serious kidnapping charge was reportedly in the works against Kincannon, who according to a police report grabbed his wife Ashely Griffith‘s arm during a March 26 argument in their car, “squeezing it tightly, thus preventing her from exiting the vehicle.”

Griffith told police Kincannon threatened to kill her, himself and her family during the incident – threats he is accused of having made previously.

According to Kincannon, he “accidentally overdosed” on the prescription drug Benzonatate – which he says he took to deal with an upper respiratory infection.

“Basically, I went completely crazy after taking it,” Kincannon told The (Charleston, S.C.) City Paper, the news outlet which first broke the story on March 28. “I don’t even remember all of it.  My wife called 911 because she was worried about me and my behavior was way out of character and erratic, and she was afraid for her safety and mine.”

Will police be able to make the CDV charge?

Remember, Kincannon and Griffith issued a joint statement last week in response to the incident.  In that statement, the couple said they would not be “voluntarily participating in any further inquiries” related to the incident – nor “testifying in any court proceedings related to this matter.”

It’s not immediately clear how such a “united front” will complicate Kincannon’s prosecution.

Kincannon – the self-described “honey badger of American politics” – has been inflaming the far left for years with his over-the-top social media pronouncements.  No wonder liberal websites across the country have been gleefully documenting his latest troubles.

Closer to home, Kincannon’s arrest is likely to reignite a contentious debate over CDV reform – which has already been dominating headlines (and dogging GOP leaders) in South Carolina.

Kincannon and Griffith remain separated in the aftermath of last month’s incident, however sources close to the investigation tell FITS Griffith has already requested that a “no contact” order typically issued in CDV cases be waived in this case.

My guess and it’s only a guess is that this was made under the “must arrest” CDV law. In the joint statement they made it was made clear that she would not cooperate in any investigation so the kidnapping charge would be impossible to prosecute. The CDV charge will likely go in to the trash heap of history as well unless he pleads guilty or she changes her mind, but our “Republican” state legislators decided that we should have a must arrest statute on the books in order to please the MSM and waste more $$$$.

We don’t know what has gone on between the statement and now. Maybe she changed her mind, or maybe that statement was bull. Is a joint statement to the media legally binding? Don’t think so. Especially if it was predicated on him leaving her alone, which somehow I can’t imagine him sticking to.

I doubt it’s legally binding, though if she breaks it I can see TK going after her for breach of contract in court, because he’s just that kind of guy. Though she might change her mind and testify if so then it could go somewhere. If she’s not going to testify or cooperate then it is going to be a difficult if not impossible case to try. They can’t force her to testify since they are married, and prosecuting a case against an attorney with no witnesses, and other than one police report and some random audio she posted on the internet no evidence is likely not worth it.

PS: I do think the CDV hysteria is out of control, because it has become a liberal-pop culture cause. All the attention and the laws won’t do much, if anything, to stop the lower-brow portion of culture that commits a vast majority of CDV.
As it is: the new laws will likely just make it easier for women to hate men, and give them a new weapon in what used to be non-violent arguments.

The legal system is required to focus on the issues with which it is presented. You may think CDV is no big deal, or you may not give a shit if one Repub beats up another and threatens to kill her and her family, but for LE and the courts, this must be taken seriously.

There are those, obviously, in South Carolina and elsewhere, who’d just as soon see the the legal system ignore all cases like this. One can’t help but wonder about the private lives of those who feel that way.

If there’s a police record of violence, she doesn’t need to cooperate. He can be tried on this evidence alone. There are both records of violence, and a history of trouble between them. It’s enough for the State to cross the threshold…

It’s not impossible, but it is difficult when they don’t cooperate. Some 10 years ago they decided to try these cases regardless of the cooperation of the wife in order to try to help cut down on domestic violence. That politician or sheriff or someone over in Lexington was tried like 4 or 5 times before they finally let it go or he got a defense verdict.
