JUDICIARY COMMITTEE TAKING ITS TIME WITH DOMESTIC VIOLENCE LEGISLATION

|| By FITSNEWS || S.C. Rep. Greg Delleney is delaying action on criminal domestic violence (CDV) legislation – reportedly telling his committee members not to move too quickly on the issue.

The S.C. House of Representatives version of CDV reform – H. 3433 – was referred to Delleney’s committee back on January 27.  It didn’t receive a hearing until this week.  By contrast, the State Senate passed its version of CDV reform last month.

So … what’s Delleney’s issue?

“He does not like the bill,” one State House insider told FITS.

Ok … but why not?

Well, we know Delleney is a criminal defense attorney – and no fan of the state’s solicitors (who support the legislation) – but is that reason enough for his delaying tactics?

Who knows … but Democrats and “Republicans” on the S.C. House judiciary committee tell FITS Delleney has made it clear to them he is no hurry to move the bill forward.

Frankly, we’re not sold on the Senate bill.  It strikes us as legislating for the purpose of legislating, not actually solving a problem.  If lawmakers were serious about cracking down on violence against women, then they might consider better addressing cases like THIS … or THIS.

Or … you know … just form another task force.

Be willing to bet an order of wings, beer and fries that if one of these Cockroaches went home tonight and got the living shit beat of them by their significant other they would gain a better perspective

Minus that happening the little Cockroach gods ain’t going to do a damn thing

Jim, you used to be possessed of quite a bit of common sense. What happened? When did you stop seeing this kind of useless posturing that will only create a larger swath of people who can no longer legally own guns through the population for what it really is? The true cockroaches are those anti-gun politicians such as Martin and Hembree who introduced this travesty, as well as osrensibly pro-gun sellouts such as Katrina Shealy. Nothing good will come of denying people property and protection rights on another’s mere say-so withong-delayed or denied due process.

little hazy on how CDV has turned into a gun rights issue

regardless I will try to kill two birds with one stone

the State should issue to every citizen at the age of eighteen the GOVERNOR revolver by Smith & Wesson.

The GOVERNOR will put six rounds of customizable response under each individual’s control. It can be loaded with .410 2 1/2″ shotshells, .45 ACP or .45 Colt – alone or in combination. My preference is to load every other chamber with one round of each just to even out the consequences

I do believe at this point CDV and gun control will cease to be issues

It is a bit disappointing coming from Shealy who campaigned on being pro-gun.

Yes indeed. Jake started out pro-gun and then he flipped. Katrina has done the same last year and now this. No wonder some have called her, “Jake with a skirt”.

It was about as personal to me as politics can be, did all that was within my ability to get her elected.

Still think she is a better fit than Jake perched in his “cat bird seat”

You Know My Name March 8, 2015 at 9:15 am

Same here, Purple Rain! Went to her office to sign the petition to allow her to run as independent as well as encourging others to vote for her. I said at the time,
that IF she started acting like Nikki or Jake, we should vote for het replacement, immediatly. Between her voting for Jean Toal for another term as SC Chief Justice, Voting to give as-yet undetermined officials the power to determine what makes you competent to own firearms or not, and now this, I believe Miss Katrina is due for replacement. Let’s hope a viable, non-crime-ring candidate emerges for that seat between now and 11-2016. If we wait too long, her butt will become stuck to OUR seat, same as Jake’s was.

I suspect they’re concerned that keeping guns out of the hands of domestic abusers might send the wrong message to the NRA.

FastEddy23 March 5, 2015 at 2:27 pm

LOL … That’s right, blame the guns for any and all violence. If someone is a known abuser of their spouse, that spouse should learn a bit more about gun ownership.

FYI: More children are harmed and killed by Volvos than by guns.

Ha! You always, make me laugh because we think similar.

Someone I know is going through a divorce. I’m still trying to figure out how his 400lb ass thought himself such a playboy he married someone beautiful and thought her his sugar mama? Anyways, as the story goes, with fear implied, I did mention the beauty of having a gun, size don’t matter.

Joe Biden’s shotgun will do … I’m still looking for a double barreled hand gun that takes the ol’ 410 bird shot round. There are some antiques, but nothing modern, reliable.

Tazmaniac March 5, 2015 at 2:53 pm

How about taking the hands off the domestic abusers? It would be a two for one, the vast majority of CDV is a good ole knuckle sandwich and a gun would be a tricky option, but tyrants aren’t worried about citizens rebelling with punches are they?

I remember when NRA types used to blabber that if you have gun control only criminals will have guns.

Now their position seems to be,can’t have any gun control because then the criminals won’t have their guns.

Extremism is always a vice!

What people like Larry Martin and Hembree is adding to the number of people who are classified as “criminals” in some cases without due process of law (trial and conviction) and on someone’s say-so, in an effort to gradually reduce the number of people who the government says are “permitted” to possess firearms. It is an underhanded but ambitious ploy.

With Apologies To Goldwater March 5, 2015 at 7:27 pm

Absurd.

The gun prohibition would only be applicable to one convicted of CDV.

It doesn’t have anything to do with their due process rights.

At that point, they would be a CONVICTED CRIMINAL.

Thank you. I was wondering whether people actually believed the crap that gun nuts post on sites like this. The report below is one of many that identify South Carolina as one of the worst states for abuse against women. Handguns are a part of that abuse.

As a woman, I think more women should get educated on how to use a handgun. Having said that, based on what I have read, it is more likely that a boyfriend/significant other, is more likely to kill you. For women with children, this poses a problem, how to keep handguns from the children you are trying to protect and yet be accessible in the dreadful event you need one.

a face in the crowd March 5, 2015 at 10:23 pm

With guns in reach, the probabilities associated with gun deaths and gun injuries in the family definitely increase.

You Know My Name March 6, 2015 at 1:03 pm

If the guy is a true wife beater/ stalker, then his death will be no loss to the world.

You Know My Name March 6, 2015 at 1:04 pm

Bullshit. Verbiage in the law allows for a party who obtains a restraining order from just about anywhere because they say they are afraid to cause someone to have to surrender their firearms BEFORE any conviction has taken place.

Purple Rain March 5, 2015 at 7:35 pm

I have to laugh a little in regard to firearm possession and the laws governing that. I do have a firing range and at one time a great shot and ability to handle a gun. That was 20+ years ago when I was in the military! Last I read as long as I show valid discharge papers I don’t need to pass the test to carry.

People like Hembree and Martin were stroking out about the Constitutional Carry law they were trying to pass a couple of years ago. “Blood will flow in the streets.” “It will be the Wild West.”

They said the same stuff about Restaurant Carry but as is almost always the case, it just didn’t happen.

Purple Rain March 5, 2015 at 7:48 pm

The core issue is not necessarily guns nor protection IMO. It is as you say based on “say so” and on top of that, let us assume someone is actually convicted once, they serve their time, should they ever be permitted to carry a firearm?

We see this across the board, let’s test those unemployment recipients for drugs.

If a convicted felon, even what I consider a petty $50 transaction, they aren’t eligible for certain benefits.

If someone commits a crime, pays their fine or does their time, why should they be forever prosecuted? They have already paid for their mistakes/actions. How many ways should they pay?

Got no problem with taking a gun, freedom, or even life itself, from a true wife BEATER. The problem with this stupid bill, as with the existing “must arrest” CDV law, is that a lot of people lose their rights over a red mark or a minor scratch that in many cases was put there in an effort to get away from an irrational “victim” who was the real aggressor or perhaps who may have inflicted the “injury” on themselves with full intent of costing the accused their freedom, other rights, or career, as a get back for some trangression, either real or imagined. It DOES happen.

Any of you the say the Second Amendment Rights and The removing of guns because of Domestic Violence are the same are as backwards as Bubba! If you kill a deer at night you lose your gun rights, kill one out of season and you lose your gun rights, but beat the hell out of your spouse or threaten to kill them – oh hell keep your gun, it ain’t no crime till you kill them! Oh and the baseball bat argument that is just as stupid, yes they can beat them to death with a baseball bat and that new bill did make the penalties stronger for those violations. So you dumb bubbas who wanna keep your guns – stop beaten your wife! Why don’t you leave her and just go live in the hunt camp or where ever it is that folks like that stuff. As for Shealy, she supported cwp but just because she doesn’t like to see people beat up and killed I guess she is bad?? Yall are all just stupid. And that Dellany man – wait til those folks against domestic violence get ahold of him! I bet he gets a person running against him in 2016 – I hear they are already looking!!!

May almost always means will. Are you referring to “may arrest”?

I hope you are never even accused of anything close, because I feel confident, based on current laws and interpretation, “may” means will, when, if ,they want to.

If that isn’t your point would love to hear your side.
