BUT IS IT REALLY A “STEP FOWARD?”
|| By FITSNEWS || The South Carolina Senate passed legislation aimed at curbing criminal domestic violence (CDV) in the Palmetto State – which historically ranks among the nation’s leaders in the percentage of women killed by men.
Why is that? Hmmmmm … we’ve got some ideas (click HERE and HERE).
Anyway … the legislation engendered tremendous controversy owing to provisions that would deprive certain CDV offenders of their gun rights. Federal law already imposes a lifetime ban on gun ownership for any CDV offender, although local and state law enforcement would have to refer such charges to federal prosecutors (who are unlikely to move on them in absence of a compelling reason).
The final version of the legislation permits “judicial discretion” on stripping gun rights for some CDV offenders – an amendment introduced by S.C. Senator Chip Campsen.
Really? Because last time we checked “judicial discretion” in South Carolina was pretty much up to the legislative branch, which taps judicial nominees and then appoints them via notoriously corrupt legislative elections.
“I appreciate my colleagues working across the aisle to push this bill through,” S.C. Senator Larry Martin said in a statement. “South Carolina needs tougher domestic violence laws and this is a step in the right direction.”
The bill sparked a national controversy when one “Republican” State Senator – Thomas Corbin – got into a heated argument at a legislative dinner with the bill’s primary sponsor, S.C. Senator Katrina Shealy.
Corbin told Shealy – the only female member of the State Senate – that women were “lesser cuts of meat.”
Ruh-roh …
Shealy pushed back against Corbin’s remarks – and used them to build support for her legislation.
“I am happy that we stayed today and worked out a compromise in the domestic violence bill,” Shealy said in a statement. “It is a strong bill although we did not get everything we wanted.”
Former prosecutor Greg Hembree – the State Senator who chaired a special domestic violence subcommittee – also praised the legislation.
“I am proud of my colleges for working tirelessly on this bill,” Hembree said in a statement. “We worked hard in the off session in subcommittees and in full Judiciary Committee to get the best bill through the Senate. We heard grueling testimony of families who have been victims.”
Still, some feel the chamber missed an opportunity during the debate over the legislation …
“I wish someone would go to the well (of the Senate) and talk about how damaging and abusive words are and stare down Corbin,” one State House insider told FITS. “They’re only talking about physical abuse and bodily harm in this debate. I get why. But a personal point would be in order.”

South Carolina has passed a criminal domestic violence bill that marginally addresses the issue … in the process earning the state yet another national black eye for its backwardness. Meanwhile the true savagery that lurks at the heart of this issue goes unaddressed … while the politically connected in the state continue to evade accountability when they break the law.

The current law allows a man to hospitalize the woman in his life twice before it becomes a felony on the third attempt on her life. It’s a total failure by both parties and the backwoods thinking of SC.

It is based more on socio-economic status. African Americans have more poverty and rates are higher among the poor. Same research that you are quoting.

Enforce the current law ? Are you crazy ? Politicians have to “do something”. “Shoot something at somebody”, “Pass a new law.” Otherwise the uninformed voters would see them for what they are. There is a bill somewhere in the system that sunsets all rules every so many years. They have to be brought back and be voted on again. That in and of itself should keep them busy enough so they don’t have time to screw up other new things. Great idea. There are still obscure laws on the books from the 1800s that some smart lawyers use to win cases today. Sadly it’s not just Dims.

SC must lead the nation in murder-suicides, almost always with the male as the trigger man. Another one in the news today in Belton. Corbin had an opinion piece in the paper today about balancing due process (taking away gun rights) with protecting victims/potential victims. He spotted this issues, but I’m not sure Corbin should be the spokesman for anything that involves balancing rights, nuance, etc. Maybe he could be a spokesman for an all you can eat, males only, chinese buffet……

SC is in the top 5 worse places to get a divorce in the entire United States.
It takes over 18 months on average to get a no fault divorce.
That’s insane.
Most States take about 90 days or less.
Forcing people who hate each other to stay together creates domestic violence.

You guys who are hung up on the 2nd Amendment aspect of this law, I’m curious…is there any kind of violent crimes where you believe a convicted criminal should have his/her possession of a gun restricted?
If there is actual violence with “real” injury or threat of violence with a gun or knife, fine. A bruise or a superficial scratch or red mark from pushing someone out of the way or a dirty look; no.
I don’t think gun restriction is the answer. I strongly believe we need stronger mental health clinics. People who do stupid crap need help and can change “sometimes” why restrict all their rights? Particularly the young?

I agree the bill does little to prevent CDV, however, I disagree in the case of capital punishment linked in. I refuse to believe that some are beyond help. I in no way support the death penalty. It is cheaper and far more humane to commit them to prison for life than it is to try to put them to death. What is the death penalty for? Vengeance? Anger? That isn’t bringing anyone back from the dead.
Mental Health may be the answer in cases like this. Yes, SC does seem to lead the nation or at least in the pack, for CDV but it also has to do with prejudices, divorce laws, and in general outdated legislation. People do change, why not spend more time revisiting divorce laws vs. taking away rights.
Kudos to the Senate for passing a bill that will make (ex)wifebeaters like Curtis Loftis think twice before they strike a woman again. Even getting arrested hasn’t prevented him from bullying women in the workplace – even if they don’t work for him.
We need to tackle the real root of the problem. Teach those winches to listen the first time!

Those entrusted with the investigation and prosecution of CDV offenses need much, much more training. 90% of CDV complaints are bogus; the remaining 10% can be homicidally dangerous. Problem is, those responsible for the investigation and prosecution do not understand how to differentiate between the two. An arrest alone can result in utter destruction of an innocent person’s reputation, job or career loss and untold legal expenses. With the various penalties now in place that abrogate 2nd Amendment rights, it is even more important that the aforementioned be adhered to. I speak from personal experience. Mr. House Member, Mr. Senator: utilize the utmost caution in pursuing this legislation.
A word of caution: Be careful, very careful about what you post concerning CDV. I had a post taken completely out of context which cost me in excess of 150,000.00 ordered by a judge who had not a clue what he was doing. Or, maybe he did. Be careful.
