Katrina Shealy Promotes Anti-CDV Bill

|| By FITSNEWS || S.C. Senator Katrina Shealy appears in a new video urging her colleagues to pass S. 3 – legislation which would restrict gun ownership to those convicted of criminal domestic violence (CDV).

The Palmetto State ranks among the nation’s leaders in terms of the percentage of men who kill women – although the last high-profile domestic violence fatality involved a woman shooting a man.

Go figure.  Anyway, the CDV issue has been a major headache for “Republicans” in Columbia.  S.C. governor Nikki Haley in particular has been ripped for her “response” – which one Democratic lawmaker recently referred to as nothing more than “a 30-minute press conference and photo-op.”

Ouch …

Of course the real hypocrisy involves the case of Brad Eckstrom – son of S.C. comptroller general Richard Eckstrom.  His charges are getting dropped as part of a “pre-trial intervention” program – even though he stands accused of punching, kicking and grabbing his 29-year-old former fiancee Blair Pettrey by the hair, and dragging her across his mother’s home.

“Do as they say, not as they do,” right?

Anyway, we have no reason to believe Shealy is not well-intentioned in her advocacy on behalf of this legislation – just as we believe S.C. attorney general Alan Wilson (reference by Shealy in the clip below) is serious about his efforts.

Does that mean we think it should pass?

Eh …

Any proposed restriction of gun ownership is serious business – and should not be entered into lightly.  And certainly first-time offenders (with no history of previous criminal violence) should not be subjected to such draconian consequences.

Oh well, here’s Shealy’s thoughts on the matter …

I would love to hear from the real Kev(in). Sounds like he could really expedite the process of Curtis no longer serving in office and helping with his relocation to FEDERAL prison. Not everyone convicted of CDV is a wife “beater”. All it takes to get you arrested is for her to have a red mark or bruise on her arm, or elsewhere and for her to tell the cops that you did it. A lot of men and even women have been jailed and convicted on just such “evidence”, forever losing their right to a firearm for self defense, hunting, or target shooting. In a lot of cases, the “victim” gets in the way of the accused as they are trying to do the rational thing and leave, often physically assaulting the accused in an effort to get the accused to push or grab them to move the victim out of the way so CDV charges can be brought.
A minor bruise or red mark is not a beating, but under our laws, it is treated as such. I agree with Will on this. Katrina is really starting to look less and less like she will get a third vote from me.

You try to do the rational thing and leave and he blocks your exit. You grab his arm to push or pull him out of the way so you can leave and in the process, you leave a little red mark or bruise. The cops come, called by yourself or maybe a neighbor, and take YOU to jail because he said you put the red mark or bruise on him. Do you really believe that you should forever lose your right to be armed, maybe your career if you’re a cop or soldier, because of this?

This argument is beyond in stupid. Under that scenario you should plead not guilty. If you are prosecuted, you should defend yourself in court. That is the way the criminal justice system works. If you are not guilty, don’t plead guilty. Ask for a jury trial.

You seem very failure with this situation, so it is probably based on something real. But I am willing to bet the story went more like this.

Your wife found out you were sleeping with another woman, She is furious. The two of you begin to scream and yell at each other. You scream some obscenity, grab your coat and head toward the door. You wife puts her hand across the door and says you are not leaving until you hear what I have to say. You grab her arm and slam here against a wall, calling her a some obscene name. She ends up with multiple bruises. You are concerned she will call the police, so you call them first. After the interviews, the police conclude you possibly abused your wife and arrest you.

You make a lot of presumptions but the scenario as I gave it happens. It has not happened to me personally, but it happens. When someone, not realizing the ramifications of doing so, pleads guilty or fails to put up a defense for what they saw as a minor incident, with no serious injury, they pretty well give up rights for life that should not be lost. Basic rules of conduct and law say there should be no hostile laying on of hands by either party against the other, regardless of how pissed off one may be.

You seem okay with the woman getting physical with the man if she suspects he is screwing around. A lot of these stories start like this. Given the premise that no one owns anyone in this day and time, such laying on of hands is wrong, whether you have a vagina or not. Holding someone against their will is technically kidnapping, but the laws and cops’training is frequhfently slanted to make the woman out as the victim, even when she is the initial aggressor.

Not Curtis. I generally agree that a man should not hitca woman, but acknowledge that there are exceptions to every rule. I have seen a good share of CDV “victims”, who even when the cops were present, went out of their way to try and provoke a physical response from the man. When. a woman is pushing, tearing clothes, knocking glasses of of a man’s face, a one time hand print across her face would not be that far out of line, IMHO. Not talking about broken bones, loose, teeth, or worse. Obviously, many of you have never seen how irrational and violent some of these women get when drunk, high, pissed off, or all of the above.

The guy was wise to the conspiracy, due to an overheard phone conversation between the woman and her paramour!
The woman found the PI’s tracking device on her car and attempted the fake CDV. The X had filed a report a few days prior, the woman had not 1 hair out of place, no marks, no bruises and the attempt failed!
This is how evil and low some women can be!

These people attempt, with the help of the Law, to frame innocent people, either as a cover up, or a vendetta, when they have “Law Enforcement on lock down”, or in their pockets.

A Tea Party friend of mine said Katrina was Jake in a skirt. (Talk about a revolting mental picture) I wouldn’t put her anywhere near that but she tends to let her heart over ride her brain. When the vote came up on the mental defectives losing their guns I asked her: who makes the decision as to competence ? In some circles just being a veteran is enough to be considered mentally unstable. The problem being not what the condition is but who makes the decision. With the CDV a conviction for pushing is like a conviction for beating. Same punishment, two very different crimes. There at least needs to be some leeway for the judge.

I will say this once “here” as I have said it many times before, domestic abusers will not obey gun laws. This may help in that it gives law enforcement another charge against the abuser, but he will not obey this law and it is likely he won’t get caught until someone is killed or injured.

If they have large gun collections, they will just be that more enraged and prone to violence.

There is a very clear difference. Every time someone is robbed or murdered, there is a victim. This is a law against someone who likely will never harm anyone with a gun. The vast majority of CDV abusers never use a gun in a crime. People will know he does not have a gun. the family may be in danger from someone else.

How many of those 36 abusers killed their victim before ever having any contact with the legal system for CDV?
How many of those 36 abuser/killers legally possessed the gun used?
In other words, how many deaths would even be effected, but not necessarily prevented by this law?

And, cops should not have the option to a call to a house as an A&B instead of a CDV if it is a CDV.
That’s why this is all for show. I remember when the law was passed to bump it up to circuit court on the 3rd offense. That’s when some cops in the county where I was working started the A&B scam.
If the front line cop ignores the law, the legislature is wasting its time. But, grandstanding is so much fun.

There should be three levels of CDV. The push or shove should not be punished like killing. I’m not up on this stuff but it makes sense to me. First time, no injury, shouldn’t take guns away forever. But on up the ladder might need to be addressed differently. Katrina seems to have fallen for the anti-gun crowds unending effort to rob US of our Constitutional rights by hook or crook., I still support her but she has fallen for the anti-gun crap twice now.

She is rapidly losing my support. Between her vote for Jean Toal and now this, I’m thinking it might be good to unseat her before her butt becomes Super-Glued to OUR Senate seat as did Jake’s. No doubt, because of one or two good acts in the past NRA-ILA will give her endorsements and contributions for life or until we vote her out, same as they did with Jake and same as they do with Mike Pitts.

I said when we elected her the first time, that if she started to screw up, we could vote her out. That time may be approaching.

Nothing new here, more circus acts! I’ve been in LE for 15 years and until you have judges on bench who will hand out due reward for violent acts and a prison system that focuses on punishment it’s all a waste. Prison is not for rehabilitation and until we get that repeat offenders will continue to plague our society. Order of Protection / Restraining Orders nothing but paper. Paper has never stopped an act of violence and adding more layers of paper will not change it now. People who are willing to take a stand both in the court and when encountering an act of violence are the only hope.

Once again proving there are no female libertarians. CDV as a concept implies women are special and deserve more consideration when assaulted. This is unconstitutional. CDV charges are pressed by women overwhelmingly and place the burden of proof on the alleged assailant to prove their innocence. 1 more reason not to get married – now the little missus can take away your right to bear arms at her leisure.

The real problem is the way the current law is written and how its interpreted. Quite recently a former coworker of mine was locked up for doing nothing more than. Trying to leave. He never touched her she never claimed he touched her, but stated he didn’t know what he was going to do. The state charged him saying he created fear of imminent perril. He lost his law enforcement job and nearly his child. The charges were later dropped because they found out she lied, but the damage to his career was done. The law is way to vague and because of this the CDV law gets used as a pay back. ( in this instance it was a pay him back for leaving her because she got caught with several other men).

This seems like so much common sense that it surely will not pass in this 39 men/1 woman Senate. Especially with the guy who called he a “”lesser piece of meat”.

Firearm transfers (purchases) fall under the jurisdiction of the BATF and it is already a federal law that anyone convicted of CDV is prohibited. Why are we wasting time with this on a state level?
