CONTROVERSIAL IMMIGRATION EDICTS ON HOLD … FOR NOW
|| By FITSNEWS || While the battle rages on in Washington, D.C. over funding for its implementation, a federal judge in South Texas has ruled U.S. president Barack Obama‘s executive amnesty program unconstitutional.
Which … let’s face it … it is.
According to the ruling from district court judge Andrew Hanen – issued in response to this lawsuit – Obama’s amnesty orders exceeded his constitutional powers by granting the U.S. Department of Homeland Security (DHS) the authority to grant “benefits and privileges” to more than four million illegal aliens.
Accordingly, Hanen has issued an injunction in the case barring the administration from implementing its directives. Obama’s administration immediately signaled its intention to appeal the ruling.
“The DHS was not given any ‘discretion by law’ to give 4.3 million removable aliens what the DHS itself labels as ‘legal presence,’ ” Hanen wrote in issuing the injunction. “In fact, the law mandates that these illegally-present individuals be removed. The DHS has adopted a new rule that substantially changes both the status and employability of millions. These changes go beyond mere enforcement or even non-enforcement of this nation’s immigration scheme.”
Exactly.
The U.S. House voted last month to defund the executive amnesty provisions of the DHS budget – which is set to expire on February 28 (the agency was excluded from the broader “budget betrayal” approved last December by a lame duck Congress).
U.S. Rep. Mick Mulvaney – who has been pushing efforts to de-fund the controversial measure – praised the ruling.
“Presidents have the executive authority to do things like delay prosecution, but they cannot change the law in order to grant benefits,” Mulvaney wrote on his Facebook page. “I wholeheartedly agree with this decision.”
Mulvaney added that “the Constitution exists to protect all of us, and ignoring it just because we like the outcomes of ignoring it – where the ends justify the means – is one of the most frightening things I have encountered.”

This website has never breathed fire on the issue of illegal immigration. We’ve consistently urged pathways to status and other “progressive” reforms as possible solutions – although we’ve always acknowledged that border security (i.e. turning off the illegal alien spigot) is one of the few things government is supposed to do.
Of course no matter what one thinks of Obama’s proposals … their substance isn’t the issue.
The issue – as Hanen and Mulvaney have stated – is whether presidents have the authority to arbitrarily change laws they disagree with. We don’t think they do – and last time we checked, neither did the U.S. Constitution.
Obviously this is the first stage in a long fight … one that will play out in the courts and in the U.S. Congress, where Democrats in the U.S. Senate are under pressure to pass a DHS budget that removes funding for the program.
It’s also worth noting that no matter how the fight turns out, effective amnesty is already in place … and isn’t going anywhere anytime soon.
“The DHS may continue to prosecute or not prosecute these illegally-present individuals, as current laws dictate,” Hanen wrote in his opinion. “This has been the status quo for at least the last five years.”

Not boz but i think they will fast track it and I honestly believe by fall they will have a decision. Texas hand picked a GW BUsh appointment who has known issues with Obama etc, the court of appeals has always been very conservative so its on a fast track to SCOTUS in my opinion.

It may be overturned, it may not. It’s still unconstitutional no matter what the ‘high court’ tries to say. “Napolitano called Hanen’s ruling “rare,” saying one federal judge usually does not decide to stop the president from doing something. He said it’s more common for a federal judge to let an appeals court decide.
“You could count on one hand the number of times a single federal judge has done this to a President of the United States since World War II and you would not use all your fingers,” he said.
The case now moves to the Fifth Circuit Court of Appeals that covers New Orleans and Houston.
Napolitano said the amnesty program is on hold “probably forever” unless the appeals court decides to overturn Hanen’s injunction.

Citizenship and voting, Is not a major concern of the vast majority of these folks. They just want to work in the open and be allowed to stay in the US with their Children, who are citizens and will have the right to vote. When they came here they did not harbor the belief they would be citizens and vote. They came looking for jobs and opportunity.
I look at it this way. Regardless of what happens here, Hispanics know Republicans are to blame and that can’t be bad. As they age and become voters, the children of these folks won’t forget the treatment of their parents.

So first off, this gets appealed, and the injunction is probably lifted, or it’s fast tracked to the Supreme Court. Either way, it probably ends up with the Supreme Court in June. That’s about as far out as the GOP can afford this issue to be out there. And Jeb can’t afford to have to squabble with the riff raff candidates over immigration, because the debate itself, regardless of policy positions, is the poison pill for Latino voters relative to the GOP. That aside, from the legal standpoint, the Administration will probably be able to make the broader case that since this relates to people already here, it places no new undo burden on any states, thus no damages. The EO effectively says, if you’ve been here since a certain period of time, have not committed a felony and have a family here, you can apply for a temporary work permit that allows you to earn a living until your case is adjucated, or until there is a reform to address your legal status. You’re still here illegaly, and your status will still need to be resolved. Same holds true for Dreamers. Since the SCOTUS has already tacitly upheld the policy for Dreamers when they ordered Arizona to issue drivers licenses to Dreamers, they’re likely to uphold the EO. The reason is simple, from the view of the SCOTUS, it relates to an issue that needs to be solved for legislatively. They will likely punt by allowing the EO to stand, throwing it back, in essence, to Congress to resolve through legislative reform. On a side note, what is funny here, is that the Texas court is saying the states are suffering damage. But that leaves only two other options. They remain in legal limbo, which is the status quo, or they are deported immediately, which, in fact, would cause greater damage to the states in the form of lower tax revenues, depressed property values and in the case of agricultural sectors, an inability to harvest crops. Another cut off nose to spite face moment for the GOP. Either way in the end, the GOP’s gloating over this ruling only makes it that much harder to win the White House in 2016. OK – feel free to now attack me and my family.
