|| By FITSNEWS || South Carolina lawmakers are preparing a major push to expand the legality of marijuana in the Palmetto State – for medical purposes, anyway.

S.C. Senator Tom Davis and State Representative Jenny Horne are preparing companion legislation that would “create a medical marijuana program for cultivation, product testing, quality and dispensing.”

Good … we approve.  The “Republican-controlled” S.C. General Assembly should pass this legislation immediately – and governor Nikki Haley should sign it the moment it reaches her desk.  Assuming, of course these GOP leaders wish to remain consistent with the stated ideals of their party.

“Lawmakers in South Carolina who claim to be serious about limited government, states’ rights, sound fiscal policy, and individual liberty should support the bills Jenny Horne and I are filing to allow physicians to prescribe cannabis-related substances to their patients for medicinal purposes,” Davis told FITS.  ” If a physician – after examining and consulting with a patient – believes a cannabis-related substance would be an effective medicine and relieve suffering, why in the world should the state be allowed to say otherwise?  Decades ago conservative icons such as William F. Buckley and Milton Friedman made very strong cases in favor of such legalization, but the GOP rank-and-file have routinely rejected the idea of legalization.”

Davis notes correctly, though, that things are now changing.

In addition to multiple states legalizing pot – including several for recreational purposes –  the “Republican-controlled” Congress recently defunded the federal war on medical marijuana by blocking the use of Department of Justice funds to “prevent [medical marijuana states] from implementing their own State laws that authorize the use, distribution, possession, or cultivation of medical marijuana.”

“That action by Congress is hardly surprising given the widespread support Americans have for legalizing marijuana for medicinal purposes,” Davis said.

Indeed, a recent poll from Third Way – a centrist think tank – revealed a whopping 78 percent of the country believes medical marijuana should be legal.

Davis and Horne’s medical marijuana bill isn’t the only pot-related legislation currently pending before the S.C. legislature.  S.C. Rep. Mike Pitts – a former law enforcement officer – has filed a bill to decriminalize simple possession of marijuana.

“I never once had to fight a pothead,” Pitts told WSPA TV 7 (CBS – Greenville/ Spartanburg, S.C.) last month.  “I never once had to chase a pothead.  They just did not create problems.  The only problems they created were for themselves.”

We support Pitts’ bill, too – even as the S.C. State Law Enforcement Division (SLED) fights them tooth and nail (neglecting its public safety obligations in the process).

Here’s the thing, though … legalizing marijuana for medical purposes and decriminalizing its possession (well, making it akin to a traffic ticket) doesn’t address the fundamental problem.  As long as government is still infringing upon the liberty of its citizens – not to mention wasting tax dollars on prohibition efforts and choking off a potentially vibrant economic engine – then our leaders’ job is not done.

We commend Davis and Horne (and Pitts) for taking the first few steps toward a saner South Carolina drug policy … but the basic anti-freedom, anti-free market construct remains in place.

And that’s gotta change if the Palmetto State ever hopes to move forward as a free and prosperous people …

Way to go SC. As a former resident, who now resides in CO (also a medical marijunana card holder) I can tell you that nothing but good will come with the passage of this bill. Once you get medical, go for full recreational re-legalization. The added tax revenue could address the school and roads issues that plague SC. Heck, we’re getting a sales tax refund thanks to recreational marijuana and tourism. Good luck!

Please don’t forge to call the white house comment line, and sign the petition at the white house web site, to urge the President to take Marijuana off of Schedule 1. That would allow Physicians in all 50 states to begin prescribing it immediately.

The next day, one of those students returned the favor by bringing in a marijuana edible he had swiped from his own grandmother.

“This was kind of an unintended consequence of Colorado’s new law,” said John Gates, the district’s director of school safety and security. “For crying out loud, secure your weed. If you can legally possess it, that’s fine. But it has no place in an elementary school.”

So you agree alcohol should be made illegal? How many kids get into their parents booze? I sure did and pretty much all of my friends did too. You can not overdose on cannabis and die. You can with alcohol. Not to mention all the other trouble you can get into while drunk or around drunk people. Go to a Gamecocks football game. And edibles are not a problem here. My wife is an ER nurse and the only person she has taken care of because of edibles was an elderly lady who liked her infused yogurt’s flavor so much, she over induged. You know what happens when you over indulge? You sit back and wait for it to pass. No stomach pump, no intubation. Like alcohol.

“Kids don’t know the harms of marijuana,” Doyle said.

“When you look at Denver, where most of the commercialization of marijuana has happened since 2009 in Colorado, almost a third of Denver’s high school students are using marijuana. In the 10th and 12th grade, it’s 50 percent higher than the national average – their marijuana use rates. Their 8th grade marijuana use rate is almost three times the national average,” he said.

And they still academically out preform South Carolina’s students by a very wide margin. Colorado is in the top 5 of almost every positive indicator we measure for health, happiness, economic performance and outlook, education. I don’t think we can be talking about Colorado’s students from here in SC. How many SC students smoke pot? It a whole lot. I did and so did most of my friends. Hell, many of my adult professional friends still toke up.

Well, personally I think the kids in CO are just smarter than the kids in SC regardless of whether they smoke weed or not. Whether it’s legalized or not, high school kids will still be underage to buy weed. I could expound on how kids brains are not developed and how weed can interfere with the maturation process, but I won’t. Instead just look at the Heathweed Hall grads – they ALL toke mostly starting around the 8th grade. By the time they graduate, many have already spent time in rehab; Many are addicts; many flunk out of college. Why does Heathweed tolerate the weed on and off campus? Because “it is a community based on trust”. Oh yeah, and money may not buy happiness, but it sure can buy your way out of trouble.

Some hospital officials say they are treating growing numbers of children and adults sickened by potent doses of edible marijuana. Sheriffs in neighboring states complain about stoned drivers streaming out of Colorado and through their towns.

In January 2014, the Colorado State Patrol began tracking the number of people pulled over for driving while stoned. Since then, marijuana-impaired drivers have made up about 12.5 percent of all citations for driving under the influence of drugs or alcohol.

Many of those were on other intoxicants as well (alcohol, pills). Out of over 5,000 DUI arrests, around 350 involved marijuana. If you’re going to ignore all the proven damage that alcohol does to society and people everyday, then don’t try and comment on re-legalized marijuana.

He and three other students had driven from their college in Wyoming to sample Colorado’s newly legal wares. Legal pot in Colorado was supposed to be a major new source of tax revenue. Early returns are underwhelming. The state legislature’s budget office originally forecast $67 million for the 2014-2015 fiscal year; it subsequently marked that down to $47 million.

Still, bad reactions to THC-laced treats have landed several children and adults in the emergency room and possibly led to two deaths. Consequently, the state tightened rules on labeling and dosage. Like other purveyors, LoDo now sells edibles in childproof containers. Yet standardization of packaging and THC dosage is, at best, a work in progress.”

I agree. There would definitely need to be regulations to accompany legalization of marijuana. These would likely be pretty similar to our current alcohol regulations. The fact that a couple of underage people have used marijuana is simply a sign that the regulations in Colorado may need to be tweaked. However, just like alcohol and tobacco, you still might find a couple of the more nefarious minors find a way to access it.

Walk a day in my painful shoes and you’ll know what it is like to be this way. two deaths? Any evidence of that, ‘possibly’? How many people die from alcohol each year? Thousands? Tell the mother whose daughter has seizures every thirty minutes, now quieted by tincture of cannabis oil, that she shouldn’t have it, dispensed by the way through MUSC. You don’t know what you are talking about. You want to deny relief to suffering people, just come out and say it, that is what you are supporting. I also need to point out those 60s druggies are now old, in their 70s. Peter Fonda, Captain America, is 74. People who argue against Medical Marijuana are tragically misguided, and thousands upon thousands of innocent Americans suffer and die because of them.

If you don’t like pot, don’t use it, but don’t stop Physicians from prescribing it to their patients, especially ones with Cancer.

If your kids want to smoke pot to get high, they’re already doing it. The fact that its illegal just makes it easier for them to get it and every 39 seconds someone’s life is ruined by prohibition.

I’d love for marijuana to be decriminalized, mostly so tokers on facebook would stop posting things about the wonders of industrial hemp and how weed cures everything from jock itch to cancer.

I’m all for decriminalization of marijuana and other drugs. I just think it’s funny when my friends argue for legal industrial hemp. Dude, just say you wanna smoke some weed. It’s ok.

I’m all in for Legal drugs, all of them. Take, smoke, drink anything you want, we are all supposed to be Free boys and girls. Only one small caveat, a declaration signed that absolutely no one will be receiving public/government assistance AND be taking drugs. If you think that you are a Free adult then why should others be forced to pay for your decisions and results? Of course, medical pot for someone already getting medical assistance would be different.

We need a system where everyone feels the pain of taxes that are misspent. I think you would be amazed at how austere people become when they have some skin in the game. Let’s shake on it.

Hah! Many farmers in SC have been growing excellent hybrid weed in SC since the mid-’70s. They are extremely smart about how to hide the cultivation and curing of their crops. They are poised to make an absolute killing as soon as it is legalized here. Bubba be driving a Rolls with big tires, and livin’ La Vita Loco-weed! Adele, andele, YEE-HAH!!!!!!

Actually, they’ll take a hit. Black market weed in CO is a third of what it’s worth on the street in SC. Also, with medical comes the tracking, from seed to flower on the shelf, of all retail marijuana. Any existing crop would not be eligible for legal sale. To compete with the legal medical marijuana, any one on the black market would have to drop their prices considerably, which wouldn’t make it worth all the electricity, medium, water, nutrients, time, etc. But they sure could start making some dough and not worry about jail.

This whole issue has risen to the level of a moral imperative. The more Scientists and Physicians learn about Marijuana as a Medicine, the more impressed we are that its a true “Wonder Drug”, and we don’t use that term lightly. For Cancer patients, and for so many others, Medical Marijuana is a “Gift from God.” Maybe its time for the most moralistic ones among us to start respecting it for what it is, and start treating it that way. The current situation is morally indefensible. It is immoral to leave Marijuana on Schedule 1 for even one second longer. Its time to let Physicians in all 50 states prescribe it for their patients as they see fit — as the law lets them do with every medication out there.

This is a GREAT article!!! I am a South Carolina residence. I do not participate in marijuana use, but I fully support it in every shape & form. Day by Day for The past two years, to the end of last October, I watch my Mother suffer from stage 4 lung cancer until she finally took her last breath. It was 1 the most horrific things I have ever experienced. She was in so much pain & stayed nauseated from Chemo & Radiation. She had always been against marijuana, but her illness was so bad because NOTHING the doctors prescribed her would help her not one bit. So, she was willing to try marijuana, but they wouldn’t allow her to because U all know why. Because of all the OLD prohibitionists that want get with the program. The majority of South & North Carolinians support marijuana for medical & recreational marijuana. So, ALL I CAN SAY IS TO ALL THE POLITICIANS; YOU BETTER GET WITH THE PROGRAM & END PROHIBITION OR GET READY TO BE VOTED OUTTA OFFICE BECAUSE THERE IS ALOT OF TALK, AND YALLS BULLSHIT IS ABOUT TO WALK, RIGHT OUT OF YOUR POSITIONS!!! THIS IS A FOR WARNNG!!!

I went through the hard chemo for months–it was agony, and I will never be back to 100%. Some days I can barely walk. it triggered an auto-immune disease that I genetically carried, which now rages as my body fights everything in overdrive. This morning and every morning, my hands are the size of baseball mitts, from the lymphatic system no longer working properly, same goes for ankles. And i struggle with nausea that frequently makes it impossible to eat, yesterday I ate exactly nothing, the day before a danish and some toast–not a healthy diet, but hey, I lost 35 pounds and continue to drop. If a suffering person signs on to pain management, they piss test every thirty days for marijuana. So that’s off the table, literally off the table. the system makes people in my situation feel like criminals to begin with–God forbid we ingest anything at all that might make us feel better for five minutes, enough to want to eat. It also calms the damaged nerve endings from neuropathy. So I do feel your pain. Guardian Angel, we need to write our legislators, and tell our stories. i did make contact around the last election, and maybe it got through. But now that the boys are back in town, I need to hammer them with calls and letters. I feel like I am being punished for being sick. It was the DoJ that changed the prescribing rules for refills, requiring me and everyone else with chronic conditions to physically drive to my doctor’s office to pick up paper prescriptions and present them to the pharmacy EVERY MONTH, even though a new JAMA study said that prescription deaths from abuse have declined since 2009! The cruelty of that alone is hard to fathom. I’d like to see a score card of who is for legalization for medical reasons, and who is against. Anyone opposed needs to be voted out, their judgement cannot be trusted on anything if they can’t see the light on this issue.

I am sorry to hear that you are going through such a terrible horrific journey! I will defenately keep you in my thoughts and prayers. It really saddens me! I hate seeing anyone in your position. That’s why I am fighting for this cause! Its sad that our government does not care about it citizens more than they do. You shouldn’t have to go through the trouble you do to get any of your meds. But I am planning to contact our state officials & hound them until they finally respond with a quicker action to get it passed, because you & people like you with your condition just don’t deserve to go in pain & nausea like that! All we can do is try. But I believe will will be successful! They just need to hurry! I wish U the best & I will def keep u in my thoughts & prayers & put you in my church’s prayer warriors list to pray for!

Legalize medical marijuana in SC, and look no further for the money to fix our roads. Let the pot heads pay to fix them, and not the people who by gas to cut their grass in their yards, or to drive their vehicles to work, or to go and buy groceries to feed their families. Pot heads are going to smoke it legal or not, so why not tax it over letting it cost the state for locking them up for having before they have smoked it….
