“DO’S” AND “DON’TS” FROM THE PALMETTO STATE

By FITSNEWS  ||  We know South Carolina has the worst drivers in the country … but apparently our state has some dumb cops on the road as well.

For example, consider the off-duty police officer who recently (and quite unsuccessfully) tried to detain a law school student traveling through the Palmetto State.

According to Alex Jones’ Info Wars, “the incident began when the female driver passed and flipped off a vehicle that she says was impeding traffic by driving excessively slow in the fast lane.”

Well …

Anybody wanna guess what happened next?

“The slow vehicle, which turned out to be an unmarked police car, immediately began tailgating the female driver and flashing its lights,” the report continued.

And here’s the resulting exchange …

(Click to play)

(Vid: Via)

Interesting …

Apparently off-duty cops have no right to detain individuals simply for being rude.

“He pulled me over, not because he had reason to, but simply because he ‘could’ – this is evident by the first comment he made when he approached my car,” the woman said. “While I have all the respect in the world for officers, and appreciate what they do for us on a daily basis, I will not tolerate abuse of power – and neither should you.”

That’s true … although this entire situation could have been avoided if both drivers had simply followed some simple rules of the road.

Cops?  Whether you are on- or off-duty, don’t slow roll.  Seriously.  Everybody else is going to go ten miles per hour over the posted speed limit – and so should you (especially in the fast lane).

Drivers?  Keep your one-finger salutes to yourself … especially around Christmas time!

That happened to me once. Coming back from dinner one night, dude driving about 55 in the fast lane on I26, I flashed my lights, he moved over, when I passed he lit me up. It was a county mountie with his wife in the car. Proceeded to dress me down for flashing my lights. I didn’t want trouble so I just shut up. Asshole pig.

So, you realize that the speed limit is the same for both the “fast” AND “slow” lanes? Shoulda given your asshole self a ticket…..

It’s called common courtesy, asshole. It’s not always a matter of the letter of the law. You cruise in the right lane, you pass in the left. If someone comes up behind you in the left lane, you move over at your earliest opportunity. Most drivers who aren’t obstinate dickheads realize this.

FastEddy23 December 24, 2014 at 9:16 pm

… and if you drive too slow in the left lanes in New Jersey, if the cops don’t ticket ya, the civilians will flash their lights, honk repeatedly, take a smart phone picture of you and email it to the NJHP … fur sure.

A man was being tailgated by a stressed out woman on a busy
boulevard. Suddenly, the light turned yellow, just in front of him. He did the right thing, stopping at the crosswalk, even though he could have beaten the red light by accelerating through the intersection. The tailgating woman was furious and honked her horn, screaming in frustration as she missed her chance to get through the intersection, dropping her cell phone and makeup.

As she was still in mid-rant, she heard a tap on her window and looked up into the face a very serious police officer. The officer ordered
her to exit her car with her hands up. He took her to the police station where she was searched, finger printed, photographed, and placed in a holding cell.

After a couple of hours, a policeman approached the cell and
opened the door. She was escorted back to the booking desk where the arresting officer was waiting with her personal effects.

He said, “I’m very sorry for this mistake. You see, I pulled up behind your car while you were blowing your horn, flipping off the guy in front of you, and cussing worse than a Drill Sergeant at him.

I noticed the “WHAT WOULD JESUS DO” bumper sticker, the
“CHOOSE LIFE” license plate holder, the “FOLLOW ME TO SUNDAY SCHOOL” bumper sticker, and the chrome-plated Christian fish emblem on the trunk. Naturally………. I assumed you had stolen the car!”

It also dovetails nicely with Judeo-Christian ethics.

How do we know that? All we know right now is that he is a bit of a dufus who doesn’t even understand that if an officer pulls us over we are (by definition) “detained.” *If* he’s a cop within his jurisdiction he can pull folks over for minor offenses, if he’s that bored. He does, however, probably need a legal refresher…

Am I being detained? December 24, 2014 at 4:06 am

“All we know right now is that he is a bit of a dufus who doesn’t even
understand that if an officer pulls us over we are (by definition)
“detained.””

The assumption if he affirms detention that he has to suspect her of having committed a crime, then state the nature of the crime.

Is giving a cop the finger a crime?

Assuming this individual is a cop, I’m surprised he let her go after pulling her over(detaining her) without any suspicion of her having committed a crime.

Am I being detained? December 24, 2014 at 4:07 am

*is if he affirms

Mike at the Beach December 24, 2014 at 8:16 pm

Actually, once a cop stops us, there’s no “assumption.” They are required to possess at least reasonable suspicion that we have, are, or are about to commit some type of offense (with some exceptions, but those wouldn’t apply to the video we’re talking about). Giving a cop the finger may or may not be a crime depending upon context (although in most cases, not, but the case law on that is waaaay too complex for a discussion here), but the stop could be based upon the finger itself, or the fact that most folks who tailgate, scream at folks, and flip people off while driving have committed some other minor offense (in her case it was most likely following too closely). We don’t know, because this guy was such a schmuck that he let the petulant little bitch just ride off in to the sunset. She seemed fascinated that he may be “off-duty,” which would affect his legal authority to stop her vehicle exactly 0% in the vast majority of cases (assuming, of course, that he is actually a licensed Class law enforcement officer). A law student is a dangerous dumbass once they get halfway through that first year and start believing that they’re the exceptionally bright barristers their parents say they are.

LO December 23, 2014 at 10:45 am

This is a BS article. Probably staged to try to get a point across. It doesn’t say what road you are on. You may need to make a left turn, so you may need to be in the left lane. You should not have to break the law to appease someone else.(10 miles over the speed limit, whether you are in the left lane or right lane is telling people to break the Law)

Reply
Uh huh December 23, 2014 at 11:04 am

There are so many stupid laws that I assure you that you break at least three a day without even knowing it.

It doesn’t take a genius to drive out in holiday traffic and witness 90% of the people breaking “the law” as the scoot around town trying to get shit done.

Thank God that even the police sometimes know that the quantity and type of laws on the books are so ridiculous that even they break them and don’t universally enforce them.

Otherwise you’d have been taken to jail several times by now, and convicted.

You don’t have to break “the law” to demonstrate common courtesy.

FITS…. speed limit is the speed limit. Period. Anything over is at your own risk. Don’t like it? change the law. Until then, don’t be an ass.
That said, do we KNOW that guy was actually a cop? Lots of pretenders out there. No identification of agency provided, “flashing his lights” sounds suspiciously like headlights, not blue lights that even unmarked cruisers have. He seemed confused when she asked about being “detained”. the correct answer is YES, because in SC traffic offenses are criminal and you can go to jail for speeding -that’s why the blue ticket is called a courtesy summons. One thing he DID get right is that officers retain full authority even when not working on shift…. always “on duty” is actually the correct answer. That said, most agencies have policies regarding when and how to act off-duty.
Bottom line, I think it was an impersonator. That said, Law students are some of the most arrogant and least-informed people you can come into contact with.

If he’s at the limit though, the cop isn’t violating it.

Incidentally, I did have a grandmother get a ticket for a similar violation in California around 30 years ago.

I love her, but damn if she wasn’t stubborn on moving out of the left lane when driving at the speed limit…she worked for the DMV out there…and she had this attitude where she wanted to force everyone to obey ever stupid law on the books. She was quite rigid, but I love her anyway….I just hated driving around with her.

You might want to read a court of appeals case from a couple years ago. Cops up near rock hill will pull you over for doing the speed limit if everyone else is going 10 mph over. A reported case.

Reply
truthmonger December 23, 2014 at 11:52 am

What we don’t know is if she was doing the speed limit, or exceeding it by a few miles per hour. Also, minimum posted speed on I26 is 45mph, so use of that statute would REQUIRE a sped slower than 45 mph.

Reply
Slartibartfast December 23, 2014 at 12:47 pm

If you want to return sanity to traffic, let the traffic decide the speed on Interstates. Posted speeds should be scientifically arrived at SUGGESTIONS, only. Also, anyone who drives on our interstates must understand it’s caveat usoris. Driving too fast for conditions would then be prima faciae on those highways.

Reply
nitrat December 23, 2014 at 4:24 pm

If we want to return sanity to driving, we should lower the limit to 55 – 60. That’s the speed at which cars get their best mileage and it really is safer to not be driving at 10 miles over the speed limit with white knuckles gripping the steering wheel when the speed limit is 70.

SC rules of the road:

1. Right turn on red light after slowing down at least enough to keep from rolling over.

2. Stop within five seconds, or so, of light turning red.

3. Turn signal use is not allowed.

4. Drinking alcoholic beverages is not allowed while one is driving, though almost anything else is, from texting, to grading school papers (yeah you, the guy with “Dean” on his license plate), to any and all manner of beauty care, to essentially anything that can be contorted from behind the wheel (a reliable friend once spotted fellatio in the car aside him . . . while still within the gates of the Savannah River Site though headed out; the driver was the -ee, of course, not the -er, and the gender distinction was of the godly type for this activity).

The woman was wrong. Off duty officers have the same powers of arrest when they are off duty as they do when they are on duty. She was stopped for speeding, not flipping anyone off. That just shows her lack of character and respect for authority. Apparently the “law student” feels she make her own speed laws. If she had been in his primary jurisdiction and drove off, she would have found herself in jail. Seems you actually can be educated out of your common sense! Eleven miles over the posted limit is a 4-point violation in SC. One day she’ll try that and reality will sink in. Everyone hates the cops until they or a loved one needs one, then they want you there yesterday! If she really is a “law student,” she’s a piss poor one at that!
