The DP requires premeditation. While it probably qualifies in that regard, the prosecutors could not risk losing the conviction considering the knife, etc.

You should do a little research before you post. The Death Penalty in fact is not a deterrent. Look it up states without the death penalty actually have lower murder rates than do states with the death penalty. Doesn’t sound like it deters killings to me.
