By FITSNEWS || The S.C. Supreme Court has waded into the ongoing legal debate over gay marriage in the Palmetto State – further complicating an already convoluted progression of federal rulings.

Specifically, the state’s highest court has ruled that Palmetto judges may not accept marriage licenses until a South Carolina case currently pending before the U.S. Fourth Circuit court of appeals is resolved.

“Today’s action by the state Supreme Court upholds the rule of law in South Carolina,” S.C. Attorney General Alan Wilson said in a statement. “Based on the Court’s decision, I will continue to fulfill my oath as chief legal officer to defend the laws and the Constitution of South Carolina until this issue is resolved by the federal courts.”

South Carolina’s gay marriage ban was passed in 2006 with the support of 78 percent of the electorate – and recent polls show a slight majority of the state’s registered voters continue to oppose same sex marriages.

The latest legal drama over the issue began in late July when the fourth circuit court of appeals – based in Richmond, Virginia – ruled that state’s gay marriage ban unconstitutional.  This week, the U.S. Supreme Court – without comment – refused to hear such cases, effectively upholding the lower court ruling.

A lesbian couple who were married in Washington, D.C. challenged the Palmetto State’s ban earlier this year.  That case – Bradacs v. Haley  – was stayed by district judge Michelle Childs in April pending the outcome of the Virginia case, Bostic v. Rainey .

At this point it’s a mere formality that South Carolina’s gay marriage ban will be struck down by the appeals court … which will be the ruling of record given the U.S. Supreme Court’s refusal to intervene.

This website’s oft-stated view on this issue is abundantly clear: No government – local, state or federal – should have the ability to ban (or compel) marriage, gay or straight.  That’s because marriage isn’t a government institution, it’s a religious one – meaning the question should be left to individual congregations.

As for civil unions, the equal protection clause of the Fourteenth Amendment compels government to acknowledge both homosexual and heterosexual unions.

America is a Republic whose government is based on the rule of law, not majority rule. The Attorney General has upheld the law. Judges have a responsibility to uphold the law. There is no right to marriage in the US or SC Constitutions, so this issue should be one that is left to the state legislatures to decide. SC’s law is clear that same-sex marriage is illegal. Opinionated jurisprudence is an oxymoron, yet judges seem to think they are at liberty to rule according to their own ideology, regardless if it supports codified law or not.

One reason courts exist is to protect a minority from the majority. And if you want to debate numbers, take a look around the United States. The people have spoken as well. Loving v. Virginia (1967); Skinner v. Oklahoma (1942): Marriage is one of the “basic civil rights of man.” Take a look at Meyer v. Nebraska (1923) as well.

Zablocki v. Redhail (1978) declared that marriage is a “fundamental right.” Even Scalia endorsed that view in 1987, in Turner v. Safley.

So when you speak about the Republic, the rule of law and the US Constitution, you are wrong. SC’s law is clear that same-sex marriage is illegal, but SC’s law is inferior to US law under the Constitution that created the Republic you mentioned. There is, in fact, an entire Clause of the document dedicated to that.

South Carolina’s prohibition will officially be gone within a few weeks.

You’re right, it isn’t. However, equal (not superior) treatment under the law is and should be protected. Why should gay couples who work just as hard as anyone else be denied the benefits of marriage, to include being noted as next-of-kin if a spouse is sick or dying, Social Security, etc? Churches have the right to refuse to marry straight people if they don’t want to, such as if one party has been divorced and they have a big hang up about that. They would likewise retain the right to refuse to marry gay couples if they so desired, as it should be.

When you have so bankrupted the country, and added to the needy, where we governed over abundance, your wasting money is egregious. Ours is being used justly. I was not talking about the government or any other organization. My question was addressed to you. It was really quite simple. Politicians don’t need any more money. They get enough from PACs funded by millionaires and lobbyists.

Gee, now would be a good time, Gov Haley, to recall the General Assembly back to Columbia and pass new legislation to be signed by you…next Thursday?

Tax gay marriages at 5 million per certificate is what I am thinking. This will buy us some time for lawsuits to go through, like in 2017? By then we cam reamend our state constitution or something?

Aside from that: Gays can get married all the want. There are some “Churches” that will do the ceremony. Except most homosexuals I know got into the lifestyle (especially the men) because they know they can get sex, any time, with any other male in the gay community….The LAST thing they want is a FAITHFUL relationship..Marriage = Buzz Kill… Duh!!!

This is ALL a government handout money grab for a leftwing political special interest group, when we can LEAST afford it (thanks to their president.)

So the the answer is not just NO…It’s H#!! No..now STFU, and go home.

The state is covered with closeted gay men and women. And openly gay too. Most people under 30 don’t give a hoot about your orientation. Most gay people in the south are too afraid to be themselves. In the past, most gay people would move to another state to live bec. SC is so narrow-minded. Gays are good for the economy, they pay taxes like everyone, they vote, they buy from the same stores you do, and are equal to heterosexuals in every respect.
Gays will be able to marry in SC and I for one applaud that. Like Martin Luther King said, look to the content of a person’s character. Look at the straight men who beat their wives. Here in the Upstate a white guy killed all 5 of his kids. So don’t tell me being gay is the worse thing in the world.

After a few thousand years of one group telling another how to live their lives, one would think we should have figured out that our individual lives are not the concern of others. Humans mate. Some folks are homosexual, maybe one or few in your family past or present. So what. We could all benefit from the practice of privacy. Stop inviting ridicule and scorn and let’s all mind our own business.
