GROUP PREPARING RESPONSE TO NEGATIVE POLITICAL ADS
The S.C. Bar Association is reportedly preparing a television offensive in South Carolina aimed at “defending the legal profession” from a barrage of attack ads launched by the Republican Governors Association in the Palmetto State’s 2014 gubernatorial election.
The ads (which we covered HERE and HERE) go after S.C. Sen. Vincent Sheheen for his representation of criminals charged with both violent and sex-related crimes (including sex crimes against minors).
The ads are designed to assist incumbent “Republican” Nikki Haley – who narrowly vanquished Sheheen in a Republican “wave” election four years ago.
The bar has already issued a statement urging its members to “defend the legal profession against blanket political attacks against lawyers.”
“Each and every one of us has a professional duty to ensure that justice is not rationed but is available to everyone,” association president Alice Paylor said in the statement. “It is the job of a criminal defense lawyer to ensure his or her client has a fair trial, not to defend the crime.”
Paylor goes on to instruct her members to “help the Bar fight back.”
“Lawyers promote good government and economic growth,” she wrote. “They represent the individual, the small business, the larger entities and the government. Some of those individuals are the poorest in our communities, and lawyers go to court for them without charge.”
Expect to see those themes echoed in any television spot produced on behalf of the S.C. Bar Association …

The only way the South Carolina BAR can restore any honor to its organization is to get rid of Jean Toal. ALL members of the BAR are only there because she permits it – at her whim. Check the rules. For the BAR to make such an advertisement, Toal had to approve it – and she probably promoted it. She’s Sheheen all the way.

If I was a Republican lawyer I would be thinking; “what the F? Does my party think I should not take cases with which I don’t agree? Do my party no longer believe that every person is entitled to a lawyer?”

Of 31 Republican governors, 12 are lawyers. Susana Martinez (NM) is a former district attorney. Tom Corbett (PA) is a former assistant US Attorney and state attorney general. Brian Sandoval (NV) is a former U.S. District Court Judge and state attorney general. Of all people, they should know a little bit about the criminal justice system.

You’re guilty of allowing the facts to muddy the picture being painted.
Under our system of justice, unless a judge orders an attorney to represent someone, it is the legal right of any attorney to reject any potential client so long as the rejection is not based on race, creed, color, sex, national origin, or perhaps sexual orientation.
If an attorney refuses to represent men who have been accused of domestic violence or assaulting children, fear not. There is no shortage of well-qualified attorneys willing to represent such clients in exchange for money.
The oath that I swore to in our state supreme court says: I will assist the defenseless or oppressed by ensuring that justice is available to all citizens…Nothing in there about race, creed or other considerations. Some of the defendants I’ve represented were charged with heinous offenses – and were innocent. The only thing worse than representing someone I know is guilty, is representing someone I know is innocent.

Want me to tell you true stories about dirty SC lawyers who have/still do practice before the family court and circuit court? They should report judges for Canon violations and other lawyers for Rules of Professional Conduct violations, but they don’t in most all cases.
How do you think Nikki is our Governor?
Nikki Haley and Jean Toal are virtually twins separated at birth. They are both addicted to power, they lie as they please, they viciously attack and punish their critics and they love back room deals in order to build their power bases. They love doing political favors for people so they have to pay them back. Psychopaths, both, who have made it work for them.
Go ahead and report them. It gives Queen Jean a laugh or two when she reads the reports against the judges when they come in. For her enemies, she gets to twist the screws a little tighter. For her friends an subjects, she just laughs. Judicial and Attorney discipline is all at her discretion.
So, let me get this right…Vincent should tell these people who claim they are innocent that they are guilty and should not have a chance to be defended. Wrong on so many levels. This little game will backfire on Haley. One and done.

Vincent Sheheen is a good lawyer. When representing clients accused with a criminal offense, he has provided effective assistance of counsel. This is the duty of a lawyer under our system of justice. As a retired lawyer and as a lifelong Republican, these recent ads attacking the candidate for representing “criminals” is distressing.
