THE LATEST CHAPTER IN AMERICA’S SOCIALIZED MEDICINE TRAGI-COMEDY
In case you haven’t noticed U.S. President Barack Obama’s socialized medicine law – a.k.a. “Obamacare” – is what the cool kids call an “epic fail.”
Seriously … it’s a disaster in every sense of the word. A face plant. A wipeout. A debacle wrapped around a clusterf*ck wrapped around an implosion. The mother of all big government pooch screws …
According to Obama’s promises, the new law was going to lower health insurance premiums and shrink the federal deficit – all while protecting the ability of Americans with coverage to keep their plans (and their doctors).
On every front, the law has turned out to be one big lie … and that’s before we start addressing its colossally botched implementation.
Anyway …
This week marked another head-scratching moment for Obamacare, as the administration announced it was suspending the law’s controversial employer mandate for yet another year.
Mid-sized businesses – i.e. those which employ 50-99 workers – must offer health insurance coverage by 2016 (not 2015). Meanwhile larger businesses – i.e. those employing 100 or more workers – must offer health insurance to 70 percent of their workers beginning in 2015, not 95 percent. That higher threshold has now been pushed back to 2016.
Obamacare’s employer mandates were originally supposed to go into effect this year – but those deadlines were delayed last summer.
“They are making it up as they go along,” we noted at the time.
Ditto … and the employer mandate isn’t the only arbitrary delay, either.
Due to his most famous broken promise, Obama has also had to extend the portion of the law assigning penalties to individuals who fail to purchase health insurance (a shamelessly self-serving effort to shield vulnerable Democrats who are facing challenges in the upcoming 2014 midterm elections).
Wait … how exactly does this work? Doesn’t Congress pass laws and the administration implement them? How is Obama’s administration being permitted to rewrite this law based on its political vulnerabilities?
That’s a good question … one U.S. Sen. Rand Paul (R-Kentucky) raised months ago.
“The president doesn’t get to write legislation, and it’s illegal and unconstitutional for him to try and change legislation by himself,” Paul said.
We agree … and have said as much.
“We can’t stand Obamacare and welcome any and all delays to its job-killing, deficit-busting, premium-increasing mandates – but the last time we checked it was the job of the executive branch to enforce laws passed by Congress, not arbitrarily rewrite them based on political expedience,” we wrote last July.
Obama’s arbitrary revisions of this law aren’t just unacceptable … they are unconstitutional. The only acceptable solution to addressing the Obamacare disaster is an immediate repeal of the law and refund of all taxes collected pursuant to its implementation.

They already HAD doctors. They get better care than the paying public. They show up at the ER, and they could not be turned down. They go to ERs because they are the kind of people who do not have enough responsibility to plan. And we have paid exponentially for that…

Obviously. But what is the comparative costs between insuring the 10% of people who went to the ER for a cold, and the new, fixed it all “Obamacare”? I haven’t seen that comparison yet, but I have a pretty good idea which is cheaper.

*Dozens of Repeal/Defund/Delay with no replacement/fix attached.
*General obstructionism with changes to the law.
*Refusal to run exchanges.
*State refusal to expand Medicaid with only facing 1/10th the cost of the expansion, resulting in 5-6 million people not getting covered.
*Nothing but negative outlooks with little to no positive changes to address issues offered.
In regards to the first point, I will concede that Republicans did offer a plan fairly recently, although considering it undoes some of the greatest provisions of Obamacare, such as a ban on preexisting conditions, I absolutely can’t support it. Still, fair enough, they did finally, seriously offer a replacement.
Republicans don’t want everyone to have access to health care, their rhetoric alone shows that. In order to afford everyone some form of health care access, you can’t honestly pretend that high risk pools, free clinics, and emergency rooms are an acceptable means to those ends, that those “solutions” actually work even to an acceptable degree.
As for Obamacare, you are correct, it is not the best way to achieve those ends either, but I do believe it is an improvement. Unfortunately, the bill lacks proper cost controls, including a public option that could offer competition, especially in states like SC where the options are slim.
The best way to cover just about everyone is to embrace actual universal health care reform. The best way to do that in America, IMO, is to open up Medicare to any working adult that holds a full-time job or works the equivalent in hours. Medicaid can be made available to those who work less than full-time. Insurance would ideally be entirely optional.
Universal health care absolutely requires government intervention, and a party that openly declares it wants to be able to drown government in a bathtub has zero interests in providing that. Because of that, we will not have universal health care, will be dragged kicking and screaming to the closest semblance of reform to pass, the ACA, we will still lag behind a HUGE number of civilized countries that do have such health care, including countries the right wing declares as having more “economic freedom,” and our health care spending per capita will leave every other country on the planet in the dust, will not really have any better standing in quality than many other countries, and will still have a large portion of the populace that won’t even have access to it anyways.
We are paying out the nose for inferior health care because the system itself is broken. Obamacare’s failing is that it didn’t fundamentally change the system, it instead tried to make a broken system work just a tiny bit more acceptably. I can’t think of any other country that tolerates the bullshit system we have, and for good reason.

They would cover everyone, cost much less and the biggie is the ins. cos. wouldn’t be the controlling factor in the system. The individual would make his own decisions as to what they needed and how much they were willing to pay. The ins. cos. are going to make a ,mint off this crap and the taxpayer will get stuck with the whole bill. SSDD. Just another case of : follow the money.

That is the only thing about Health Care Savings Accts. that is not great. A provision is made to make up the difference between what a person makes and what it costs. Like the earned income tax credit it would make up the difference. Even with that give away part it would be much less expensive than Obummercare and would leave the individual in charge of their own health care not the govt. (death panels)

According to the World Health Organization, the US ranks 35 in life expectancy and Cuba ranks 38th. A US citizen could expect to live 4 months longer than a Cuban Citizen. Still, pretty pathetic. Given Cuba is an isolated third world country.

It is always a joke to me that Republicans believe they could do better than the Government in spending the taxes they pay. I would love for people to be able to opt out of all taxes, with the understanding they cannot use one thing their taxes pay for.
CL, since corporations are being treated largely as individiauls – I’m being serious from a legal stand point and not throwing out pick up lines from the last election – could an equal protection argument be made since actual human individuals are being forced to pay a penalty THIS year for less than 9 months of coverage, but businesses/corp type individuals get a free pass? I think that could get you to standing. And this would prop it up for strict scrutiny, as opposed to simply a rational basis analysis.
If a law is forcing you to do something (e.g. provide contraceptive coverage against your religious beliefs), you have standing to challenge the constitutionality of that law as applied to you. But this is the opposite situation, where Obama is unilaterally exempting people from a requirement. So either you would have businesses trying to sue over not being subject to the mandate, which is hard to call an injury, or an individual complaining about some other group getting special treatment, which is just generalized taxpayer standing.
CL, I have to respectfully disagree. Two issues here – I think you are conflating the standing and damages issues. If you have to pay the fine, then you are damages and have a potential grievance for redress – the unequal protection aspect of it is still possible even if you are not protected class.
First, the law – and the ACA clearly permit different treatment individual (which now includes corps) based on one’s level of income. However, there is a strong severability component of this. Keep in mind when upholding Obama care, the Sup. Ct. gave it a “wait and see type of approach” wherein they stated, “some states of have said they might not expand medicad” but none had opted out of the expansion – at that time – now well over 20 states did opt out. The other thing the court reasoned was that the expanded opportunity through a) tax credits/reimbursements b) expanded medicad, and c) opportunities through companies that wil “have to comply” with this Act are going to be enough to where people don’t fall through the cracks.
So for instance, if you are a person who makes too much money to get a tax incentive, or in a state that didn’t expand Medicaid (and you would have otherwise come under the expansion) AND you also work for an employer with 50-99 employees that got a pass this year, and you get fined; I think you have a pretty compelling case to challenge the executive fiat of the law. This also would permit a re-consideration of the severability arguments raised by the Solicitor Gen. prevoiusly.

The equal protection point was just one possible argument, which I think is still valid even if you are not in a protected class, as one individual (corps.) are getting to no abide by the law, and forgo the fine, where as other individuals (people) are being forced to abide by the law, but not pay a fine.
As my super smart lawyer friend say, I think this is one that would be best answered by a judge.
I am not conflating anything; a particularized injury is required to have standing. And setting aside the problems with showing the groups are similarly situated, heightened scrutiny is never applied unless a protected class or right is at issue. Not paying a tax is not, and I would predict, will never be a protected right.

It’s not the premiums that are considered taxes. I understand who the potential plaintiff is in your hypothetical. The fine is the only “tax”, and they can’t maintain a claim about a non-similarly situated group being treated differently. Also, I noted several times that you need a protected class OR a protected right, neither of which would be present here under current precedent.
CL you clarified something for me that I didn’t realize from the court’s opinion. I thought they upheld the premiums under the taxing authority of Congress and that the premiums were allowed to be regulated as ‘taxes’ similar to medicare withholdings.
Premiums are paid to the insurance company, not the treasury. The fine for not having insurance was what was construed as a tax:”The Affordable Care Act’s requirement that certain individuals pay a financial penalty for not obtaining health insurance may reasonably be characterized as a tax. Because the Constitution permits such a tax, it is not our role to forbid it, or to pass upon its wisdom or fairness.”
