THE LATEST CHAPTER IN AMERICA’S SOCIALIZED MEDICINE TRAGI-COMEDY

In case you haven’t noticed U.S. President Barack Obama’s socialized medicine law – a.k.a. “Obamacare” – is what the cool kids call an “epic fail.”

Seriously … it’s a disaster in every sense of the word. A face plant. A wipeout. A debacle wrapped around a clusterf*ck wrapped around an implosion. The mother of all big government pooch screws …

According to Obama’s promises, the new law was going to lower health insurance premiums and shrink the federal deficit – all while protecting the ability of Americans with coverage to keep their plans (and their doctors).

On every front, the law has turned out to be one big lie … and that’s before we start addressing its colossally botched implementation.

Anyway …

This week marked another head-scratching moment for Obamacare, as the administration announced it was suspending the law’s controversial employer mandate for yet another year.

Mid-sized businesses – i.e. those which employ 50-99 workers – must offer health insurance coverage by 2016 (not 2015). Meanwhile larger businesses – i.e. those employing 100 or more workers – must offer health insurance to 70 percent of their workers beginning in 2015, not 95 percent. That higher threshold has now been pushed back to 2016.

Obamacare’s employer mandates were originally supposed to go into effect this year – but those deadlines were delayed last summer.

“They are making it up as they go along,” we noted at the time.

Ditto … and the employer mandate isn’t the only arbitrary delay, either.

Due to his most famous broken promise, Obama has also had to extend the portion of the law assigning penalties to individuals who fail to purchase health insurance (a shamelessly self-serving effort to shield vulnerable Democrats who are facing challenges in the upcoming 2014 midterm elections).

Wait … how exactly does this work? Doesn’t Congress pass laws and the administration implement them? How is Obama’s administration being permitted to rewrite this law based on its political vulnerabilities?

That’s a good question … one U.S. Sen. Rand Paul (R-Kentucky) raised months ago.

“The president doesn’t get to write legislation, and it’s illegal and unconstitutional for him to try and change legislation by himself,” Paul said.

We agree … and have said as much.

“We can’t stand Obamacare and welcome any and all delays to its job-killing, deficit-busting, premium-increasing mandates – but the last time we checked it was the job of the executive branch to enforce laws passed by Congress, not arbitrarily rewrite them based on political expedience,” we wrote last July.

Obama’s arbitrary revisions of this law aren’t just unacceptable … they are unconstitutional. The only acceptable solution to addressing the Obamacare disaster is an immediate repeal of the law and refund of all taxes collected pursuant to its implementation.

Hell, it would almost be cheaper at this point just to have bought everyone a policy, or thrown them into Medicaid… That would have made the single-payer crowd happy! One step closer…

Where does the ER get the money? Does the hospital have to increase costs for that?

Norma Scok February 12, 2014 at 9:52 am

Obviously. But what is the comparative costs between insuring the 10% of people who went to the ER for a cold, and the new, fixed it all “Obamacare”? I haven’t seen that comparison yet, but I have a pretty good idea which is cheaper.
Rather than fixing just the problem of the folks who didn’t have medical care, we went and broke the whole damn thing. Smart.

euwe max February 12, 2014 at 11:26 am

Republicans blocked single payer. What is wrong with treating people’s bodies like cars, and requiring insurance? Insurance companies would rather not insure bad drivers, but it works.

We spend trillions for defense of our bodies when the enemy is 19 Saudis, but we shrink from health care?

Norma Scok February 12, 2014 at 1:57 pm

How could the gov’t paying for healthcare as single payer possibly be any better? You complain about spending for the military; what will the government do with healthcare spending with an open checkbook? We are already broke, and living on a credit card.

Smirks February 12, 2014 at 8:51 am

I think the vast majority of people of all political stripes want everyone to have access to health care

Absolutely disagree with that one.

*Dozens of Repeal/Defund/Delay with no replacement/fix attached.
*General obstructionism with changes to the law.
*Refusal to run exchanges.
*State refusal to expand Medicaid with only facing 1/10th the cost of the expansion, resulting in 5-6 million people not getting covered.
*Nothing but negative outlooks with little to no positive changes to address issues offered.

In regards to the first point, I will concede that Republicans did offer a plan fairly recently, although considering it undoes some of the greatest provisions of Obamacare, such as a ban on preexisting conditions, I absolutely can’t support it. Still, fair enough, they did finally, seriously offer a replacement.

Republicans don’t want everyone to have access to health care, their rhetoric alone shows that. In order to afford everyone some form of health care access, you can’t honestly pretend that high risk pools, free clinics, and emergency rooms are an acceptable means to those ends, that those “solutions” actually work even to an acceptable degree.

As for Obamacare, you are correct, it is not the best way to achieve those ends either, but I do believe it is an improvement. Unfortunately, the bill lacks proper cost controls, including a public option that could offer competition, especially in states like SC where the options are slim.

The best way to cover just about everyone is to embrace actual universal health care reform. The best way to do that in America, IMO, is to open up Medicare to any working adult that holds a full-time job or works the equivalent in hours. Medicaid can be made available to those who work less than full-time. Insurance would ideally be entirely optional.

Universal health care absolutely requires government intervention, and a party that openly declares it wants to be able to drown government in a bathtub has zero interests in providing that. Because of that, we will not have universal health care, will be dragged kicking and screaming to the closest semblance of reform to pass, the ACA, we will still lag behind a HUGE number of civilized countries that do have such health care, including countries the right wing declares as having more “economic freedom,” and our health care spending per capita will leave every other country on the planet in the dust, will not really have any better standing in quality than many other countries, and will still have a large portion of the populace that won’t even have access to it anyways.

We are paying out the nose for inferior health care because the system itself is broken. Obamacare’s failing is that it didn’t fundamentally change the system, it instead tried to make a broken system work just a tiny bit more acceptably. I can’t think of any other country that tolerates the bullshit system we have, and for good reason.

Guess what: ALL Children, Old People and everyone GOT healthcare BEFORE Obamacare, Dumb@$$…

Even illegals could not be TURNED down for healthcare. Even if they waited until their free doctors were closed because they were to lazy to go…they clog our ERs….

Under Obamacare the people who WORK to secure insurance are being told they can no longer get healthcare…while others are being grouped into care plans on the same level as those who don’t care about healthcare, except until they are FORCED to the doctor by pain or suffering. (the ER cloggers)…

And the investment-minded people paying, are paying three to four times more, for that inferior, non-investment-level healthcare…Dumb!@$$..

Actually the Republicans have a much better plan than Obamacare. It is health care savings accounts. They would cover everyone, cost much less and the biggie is the ins. cos. wouldn’t be the controlling factor in the system. The individual would make his own decisions as to what they needed and how much they were willing to pay. The ins. cos. are going to make a ,mint off this crap and the taxpayer will get stuck with the whole bill. SSDD. Just another case of : follow the money.

Surely Republicans do not believe this crap. What good are health care savings accounts for people who are poor. What about people who can’t get insurance. Are these the people Republicans are willing to let die. Are these the 48% who Romney was not concerned about. Republicans have no plan that does not ignore the problem of poor people and people who cannot get insurance. In short Republicans have no plan at all that does not involve letting people who cannot afford health care die.

Reply
RogueElephant February 14, 2014 at 9:45 pm

That is the only thing about Health Care Savings Accts. that is not great. A provision is made to make up the difference between what a person makes and what it costs. Like the earned income tax credit it would make up the difference. Even with that give away part it would be much less expensive than Obummercare and would leave the individual in charge of their own health care not the govt. (death panels)

Reply
Tom February 17, 2014 at 10:20 am

Oh I see the Fake News Network death panels are back. There is only one wanna be death panel, and that’s the Republican party who thinks we should decide who gets health care based on how rich you are.
Once again your earned income credit tax credit is just more of the same. What about people who do not earn enough to pay tax: and for the billionth time what about people who can’t get insurance? Lets face it Republicans don’t give a damn about anyone except rich people.
America has the worst health care system in the first world. It is even worse than many third world countries. Our people pay more for health care than anyone in the world and our results are mediocre at best. We live shorter less healthy lives than all of Europe, Canada, and Australia. We even live shorter lives than Cubans. Yet Republicans don’t care about that. They just want lower taxes.

Given Cuba is an isolated third world country.

And I think you assessments of Republican plans is very on target.

Tom February 14, 2014 at 4:02 pm

Undoubtedly you could not prove your case unless you don’t use anything taxes pay for. It is always a joke to me that Republicans believe they could do better than the Government in spending the taxes they pay. I would love for people to be able to opt out of all taxes, with the understanding they cannot use one thing their taxes pay for.

Should of bought my JD February 11, 2014 at 10:25 pm

CL, since corporations are being treated largely as individiauls – I’m being serious from a legal stand point and not throwing out pick up lines from the last election – could an equal protection argument be made since actual human individuals are being forced to pay a penalty THIS year for less than 9 months of coverage, but businesses/corp type individuals get a free pass? I think that could get you to standing. And this would prop it up for strict scrutiny, as opposed to simply a rational basis analysis.

CL February 12, 2014 at 7:43 am

If a law is forcing you to do something (e.g. provide contraceptive coverage against your religious beliefs), you have standing to challenge the constitutionality of that law as applied to you. But this is the opposite situation, where Obama is unilaterally exempting people from a requirement. So either you would have businesses trying to sue over not being subject to the mandate, which is hard to call an injury, or an individual complaining about some other group getting special treatment, which is just generalized taxpayer standing.

Should have bought my JD February 12, 2014 at 1:39 pm

CL, I have to respectfully disagree. Two issues here – I think you are conflating the standing and damages issues. If you have to pay the fine, then you are damages and have a potential grievance for redress – the unequal protection aspect of it is still possible even if you are not protected class.
First, the law – and the ACA clearly permit different treatment individual (which now includes corps) based on one’s level of income. However, there is a strong severability component of this. Keep in mind when upholding Obama care, the Sup. Ct. gave it a “wait and see type of approach” wherein they stated, “some states of have said they might not expand medicad” but none had opted out of the expansion – at that time – now well over 20 states did opt out. The other thing the court reasoned was that the expanded opportunity through a) tax credits/reimbursements b) expanded medicad, and c) opportunities through companies that wil “have to comply” with this Act are going to be enough to where people don’t fall through the cracks.
So for instance, if you are a person who makes too much money to get a tax incentive, or in a state that didn’t expand Medicaid (and you would have otherwise come under the expansion) AND you also work for an employer with 50-99 employees that got a pass this year, and you get fined; I think you have a pretty compelling case to challenge the executive fiat of the law. This also would permit a re-consideration of the severability arguments raised by the Solicitor Gen. prevoiusly.
“Well no your honors, if you sever any part of this law, it would be disasterous like we argued before – unless of course it’s the parts we are chosing to ‘self sever.'”
The equal protection point was just one possible argument, which I think is still valid even if you are not in a protected class, as one individual (corps.) are getting to no abide by the law, and forgo the fine, where as other individuals (people) are being forced to abide by the law, but not pay a fine.
As my super smart lawyer friend say, I think this is one that would be best answered by a judge.

CL February 12, 2014 at 5:01 pm

I am not conflating anything; a particularized injury is required to have standing. And setting aside the problems with showing the groups are similarly situated, heightened scrutiny is never applied unless a protected class or right is at issue. Not paying a tax is not, and I would predict, will never be a protected right.

I should have bought a JD February 12, 2014 at 5:17 pm

.
CL, again, I am not talking about the companies that are not paying a tax – nor the citizens that ARE paying premimums (which are now considered taxes) I am talking about persons who have to pay the penalty/fine – if they have to do so becuase they are not able to get it through their employer who otherwise would have had to apply. Also, I just noted that strict scruity could apply considering how the suit was brought. I would disagree agree with you that strict scruity can apply to things that are not just for protected classes. Such as impedments on fundamental rights, and if a particular statute actaully took aim direclty at a class which was not considered protected e.g. white males, or a just an ex post facto law in general. Again, I am a lowly barriaster who practices here pro hac vicci (sp?) so I’ll leave the constituational law to you yanks, but I disagree with you on this point. Which is might right as a non-American. Ha! Nice chatting with you

CL February 13, 2014 at 7:34 am

It’s not the premiums that are considered taxes. I understand who the potential plaintiff is in your hypothetical. The fine is the only “tax”, and they can’t maintain a claim about a non-similarly situated group being treated differently. Also, I noted several times that you need a protected class OR a protected right, neither of which would be present here under current precedent.

CL to the rescue February 13, 2014 at 12:18 pm

CL you clarified something for me that I didn’t realize from the court’s opinion. I thought they upheld the premiums under the taxing authority of Congress and that the premiums were allowed to be regulated as ‘taxes’ similar to medicare withholdings.

CL February 13, 2014 at 3:45 pm

Premiums are paid to the insurance company, not the treasury. The fine for not having insurance was what was construed as a tax:”The Affordable Care Act’s requirement that certain individuals pay a financial penalty for not obtaining health insurance may reasonably be characterized as a tax. Because the Constitution permits such a tax, it is not our role to forbid it, or to pass upon its wisdom or fairness.”

should have bought my JD February 13, 2014 at 5:06 pm

CL I disagree with you and the other person who now agrees with you that the premiums are not considered permissable under the taxing authority of the Cons but I also doubt we’ll convince each other either way OR that it would make a damn bit of difference if we did….

William February 12, 2014 at 9:30 am

Are you suggesting there is generalized harm to taxpayers in delaying implementation?

CL February 12, 2014 at 11:53 am

No.

Uh huh February 12, 2014 at 1:34 pm

Nah, he’s making the case for discrimination, which is normally a left leaning agenda more than a right driven one…which is interesting because if it actually happened the hypocrisy would be fun to watch.

CL February 12, 2014 at 4:56 pm

I did not make any case other than that standing is still required in our legal system.

I can’t believe that taxing people who can’t afford insurance and making legislative overrides to a 18,000 pages of regulation via Diktat isn’t working.

Instead of delays don’t we just need more Diktat’s until the central planning starts to work?

Rand Paul: Hillary Could Be Derailed by Little-Known Lewinsky Affair

WASHINGTON (The Borowitz Report) — Potential Republican Presidential candidate Sen. Rand Paul (R-Kentucky) said today that he believes he has a “secret weapon” that will derail Hillary Clinton’s 2016 White House bid: “A little-known affair between her husband and a White House intern, Monica Lewinsky.”

Appearing on the Fox News Channel, Paul told the host Sean Hannity, “Sean, when the American people find out about this scandal, they are going to be shocked, truly shocked. It didn’t get a lot of coverage at the time.”

Asked by Hannity how the scandal could have remained under wraps for so long, Paul replied, “You’ll have to ask Bill and Hillary that. Let’s just say they’ve pulled a lot of strings to keep this story out of the mainstream media.”

“Unfortunately for them, Sean, I have the details on this juicy scandal and I’m prepared to share them with the American people,” he said. “I think it’s going to be a game-changer.”

While he believes that the shocking revelations about President Clinton’s Oval Office dalliances will be enough to destroy Hillary’s 2016 ambitions, Paul confirmed that he has other arrows in his quiver.

“It turns out that Hillary was involved in a business deal called Whitewater,” he said. “When the American people find out about this, it’s going to blow their minds.”

Dems support the female agenda as long as their females understand their place, which is to service men when necessary and be tolerant of our manly ways-tolerance being a staple of the Left.

That includes swearing, fucking other women than the one’s they are “with”, drinking (wine if you’re prof, beer if you are union), and generally behaving like an ape with an advanced frontal cortex because we all believe in evolution anyway.

Thanks Lame Cliche…I love seeing who yall attack, because it shows who scares the $#!* out of you…and with that nasty hag you MUST run in 2016 (you owe her) you should be terrified.

Rand will get enough Dumb@$$ liberal-tarians because of his nutjob dad..and us Conservatives LOVE him because – from what I’ve seen- he is soundly, no questions, one of us..

And unlike Liberal-Tarians McCain and Romeny, Paul will P!$$ all over the democrat candidate, no matter what race or gender, then BEG the media to come after him…When you go on Offense, Conservatives WIN…liberals are not used to a real fight, vs people better, smarter and more successful, than them.

Getting it together. The GOP has the most representative portion of the federal gov’t..and they just defeated Obama’s immigration scheme…

And when the 2014 elections roll around, all signs are signaling the GOP getting the Senate, to even more crack the @$$ of your ignorant and failed gods in the democrat party…

So go on playing the “ism” card…that mo-fo has all but played out…especially if you don’t run a token-novelty in 2014….

PS: Are you claiming Hillary is NOT a hag???…you are a Dumb@$$…and a majority of America likely agrees…
