South Carolina schools improved their performance on the July 2013 bar exam, the results of which were released late last week by the S.C. Supreme Court.
Students from the University of South Carolina law school posted an 82.5 percent passage rate on the exam – while students from the embattled Charleston School of Law (CSOL) posted a 72.6 percent passage rate. Both of those figures were up from last July’s exam – which saw USC post a 76.2 percent passage rate and CSOL post a 68.9 percent passage rate.
The July results were also an improvement from the scores both schools posted on the February test – which saw USC pass 75 percent of its test-takers compared to CSOL’s 59.2 percent performances.
South Carolina’s bar exam – administered twice annually – has been marred by controversy in previous years. In fact six years ago the Supreme Court threw out an entire section of the exam – part of an effort to artificially raise the passage rate for CSOL.
This year’s results come as CSOL’s future is shrouded in uncertainty.

The SC Bar Exam takes place over the course of three days. The first two days consist of essay sections, and the MBE is taken on the third day. Most state bar exams are only two days long, consisting of one essay day and one day for the MBE. The MBE is a standardized multiple choice exam that is given nationally.
So, no, the SC Bar Exam is not the easiest in the country. It is grueling, and almost no one who has actually taken it before would say it is anything but extremely tough.

So what you’re saying is that it takes SC law graduates 50% longer to take the test than everyone else.
The length of a bar exam is not what makes it “hard” or “easy.” The difficulty of the questions themselves and the typical pass rate are what make a bar exam “hard” or “easy.” The SC bar exam is not the hardest or easiest in the country, by either metric. It’s pretty close to middling. You can look up the bar passage statistics by state or consider some kind of academic analysis, such as the one found here:

Alternatively, you can just listen to me because I’ve passed four different bar exams, including the SC bar and a couple of the hardest in the country. The SC bar was the easiest of the four I took. Grueling? No, it was not grueling. But there are easier ones out there, for sure.
The passage rates don’t necessarily indicate which is more difficult. In any one year, you could have more or less intelligent people taking any particular bar exam. For example, California’s is supposedly the toughest bar exam, but it has so many accredited and unaccredited schools law, that it’s inundated with mouth breathing morons who are eligible to take the bar. Furthermore, just because the grading is easier, doesn’t make the test itself easy.
I’ve taken other state bars, and SC’s was not the easiest. I think the most difficult one you take will generally be the first you take.
Mr. JackieChiles, the pass rates are a significant factor in determining how hard a bar exam is because no matter how one might feel about whether a question was easy or hard to answer, in the end, one either passes or fails. The more people fail, the harder it is to pass. It seems we are just arguing semantics, anyway. The SC bar is right in the middle in terms of difficulty. As we say on your and my favorite web site, cow just cow.
I won the pool. Thanks, Sic. I said the CSOL would be over 70% even if USC SOL was over 80% so that Cof C will buy CSOL – and CSOl will remain accredited. One of the drunk dudes at Hair of the Dog is claiming he bet on 72% and he gets the 100 bucks, but he was only on Moot Court a few years ago and got kicked off of that when he didn’t turn his final brief in or some such story. Well, the truth is, we can’t read the wet napkin now, so we don’t know who really won. Just like when Jean reads something at Nightcaps…..

Jean Toal raised the pass rate for CSOL so that Alex Sanders’ school would get accredited and be worth more $$$$. It has been proven to all beyond any reasonable doubt. And it worked for dear Alex.
