President Obama owes Ted Cruz and Mike Lee along with House Republicans an apology. He owes the tea party an apology. In fact, he owes all of America an apology.
For weeks, Obama and his minions refused offer after offer that would have delayed implementation of Obamacare for a year. They not only refused to even talk about these concerns, they demonized anyone who even suggested that putting Obamacare on pause might be in everyone’s best interest.
Now, it seems that the Obama Administration is looking to unilaterally waive enforcing the individual mandate portion of the law according to a news briefing provided by Obama press secretary Jay Carney.
Carney promised, that if people remain unable to access health insurance under Obamacare through Healthcare.gov they “will not be penalized” under the individual mandate.
What this means is that this Administration has now effectively announced that they are unilaterally and unconstitutionally delaying the two major portions of the health care law. Earlier this year, an underling at the U.S. Department of Treasury announced through a blog post that they would not be enforcing the employer mandate for a year, and now Carney has effectively announced that no one may need to sign up after all for the individual mandate due to the failure of the Healthcare.gov website.
The only problem is the Administration does not have the power to waive legal requirements under the law no matter how much sense they make.
This is exactly why Obama should approach Cruz, Lee and the tea party on bended knee asking them to bail out his failed experiment by codifying the delays that his own political appointees say are necessary.
Even more troubling in the Healthcare.gov-gate scandal is that Department of Health and Human Services Secretary Kathleen Sebelius claims that Obama never was briefed on the problems with the website. In a CNN interview she says that the President was “blindsided.”

What a joke!! Screw the Teanuts. Obama owes them nothing. The ACA says if affordable health insurance is not available there will be no penalty. That is already covered in the act. There is no reason to delay the act.
As for insurance being available, I am sure they will fix the website in short order and there are other sources. You do not have to go through the government website. Most participating insurance companies have their own website. For example, in SC you can go on the BC/BS website and and sign up for a BC/BS policy. And you can call in and get the information on participating insurance companies. After all none of this affects the 85% of the population, who already have insurance.
Further, we are quite a ways from the ending of open enrollment. Plenty of time to fix the website. If a person truly does not want to buy insurance, and feels his rights are being violated, he or she obviously was not going to sign up early, anyway. So what is the basis of their complaint. If the problems delay someone from having to do what they do not want to do, good for them. Maybe they will get hit by a car in the meantime and be denied health care because they lack insurance and die. Everybody wins. They did not have to buy insurance and we did not have to supplement their insurance.
So the only people who could complain about the delay are those people without insurance who want to participate in the exchanges. They have a legitimate beef. But that is not who the Teanuts are concerned about, is it? Those are the people the Teanuts are trying to keep from getting insurance.
Finally the Teanut Congressmen and Teanut Governors have been doing everything in their power to make this law fail since day one. It is not surprising that it did not go as smoothly as hoped. But I say move forward and get it implemented as soon as possible. The public will either like or not. I think the Teanuts are afraid the public will like it.

Seems to me if the law had been properly written none of this would have happened. Wasn’t the purpose of the ACA to insure the “30,000,000” who didn’t have access to insurance. Why not just roll out a new version of Medicare that the states had no control over – instead, we had to “…pass the bill to see what was in it…”. Well it turns out that what was in it was a poorly conceived insurance program, government intrusion, job killing coverage requirements and enough pork to please every left leaning Congressman in the country.

If the law says x must be done by March 1, it is absolutely unconstitutional for the president to say, “Just do it 6 weeks later.” That is banana republic stuff, where the executive just does whatever he wants, and the law is subject to his will.
Its not like it would be hard to get a delay from Congress if he could contain his pride enough to ask. During the shutdown the House passed a CR that was clean except for a 1 year delay. If his cynicism and hypocrisy were not so galling, it would almost be humorous that Obama has now adopted a version of the position Democrats were slandering as terroristic just a few weeks ago.
You do realize that our President is a Constitutional lawyer, right? Believe me, if the Republicans thought he did something illegal, he’d be up on charges post haste. Instead, they sit silent or perpetuate that he doesn’t have the authority to do what he did when he clearly does.

Obama does this all the time. He tells a Spanish speaking interviewer it would be unconstitutional to unilaterally implement the Dream Act, then he later does it anyway. So I guess you think Obama didn’t know what he was talking about when he said he could not usurp the legislative function.
Um, I never said that him being a lawyer meant he is always right about the law. My implication is he thought this through in a legal sense. If he is wrong, why aren’t the Republicans pouncing? They try to connect him to stuff that he is like 6 or 7 degrees away from all the time and yet the House (we are lead to believe) and Boehner are just ignoring him breaking the law directly? You’re gonna have to sell that bill of goods to Rush listeners, because anyone with a logical brain can see how that makes zero sense.
There has to be standing to object to an action, and there have been a number of lawsuits that do challenge Obama’s unilateral actions. Just off the top of my head I know of a lawsuit by the Oklahoma AG regarding the attempt to rewrite the law to allow federal exchanges to offer tax subsidies.
Once again, the executive branch has the authority on enforcement of the law. It’s that simple. Obama has set the limit on how the border patrol executes the law. He has authority to do this with the healthcare law also. The Oklahoma AG folks can sue for damages and may even get them if they can prove that delay of the law will cost them money, but they will not be able to tell the President about how he can and can’t execute the law (as if they really *want* him to put the law back in play as initially planned, anyway). It’s really weird how all these people who implored that Bush utilize the bully pulpit to enforce his will want Obama to come to Congress for everything.
The president executes and defends the laws of the country. He does not get to rewrite them to suit his purposes (as Obama acknowledged about the dream act before just acting unilaterally). There is no limiting principal to the power you are claiming.
I guess we’ll have to wait and see what all the ruckus will actually force (or allow) the President to do. But for one, when the Republicans caught Clinton they wasted no time. I wonder why there’s more talk than action when it comes to Obama….

I don’t like the “prison for profit” system, but it is either leave the country or watch helplessly while prisons ream prisoners and their families for every dime they can. They refuse to try to rehabilitate inmates anymore because successful reentry into society hurts the bottom line. And we PAY through the nose for that philosophy (both literally and figuratively).

Before you reply, you should look up the definitions: “abortion” vs. “child”. Abortion destroys fetuses. Children and fetuses are not the same thing. If they were, there would be no law against people who murder the children of pregnant women while that child is still in the womb. But I digress. My point IS that we all compromise when we send in our tax payments. We have the right to opine that our tax money is best spent elsewhere, but we have very little power other than our vote. Compromise is necessary in a country so diverse and like it or not, just because a large segment believes something, doesn’t mean they get to impose their values on everyone else.
