Off Duty SC Cop Manhandles Female Soldier

So here’s a cell phone video taken from a Buffalo Wild Wing restaurant in Columbia, S.C. last week which shows an off-duty Richland County Sheriff’s Deputy “arresting” a female soldier.

Off-duty cop Paul Derrick, 49, was drinking at the time of the incident – as was 23-year-old soldier Brittany Bell, the woman he “detained.”

According to Columbia, S.C. police, witnesses say Derrick approached Bell and became angry when she showed “no interest” in him.

Derrick then cuffed Bell, pulled her to her feet, and slammed her head into a metal table – reportedly telling her “this is how Marines deal with soldiers.” Bystanders attempted to intervene on Bell’s behalf – but he then began to berate them.

Nice …

Bell has been suspended without pay as a result of the incident.

What a dickhole. He has no business being a cop if he’s capable of doing something like that.

It will be interesting to see what comes of the meeting of Sheriff Lott and Lott Family members Santiago and Dan Johnson. Is Derrick a member of the Lott Family? If so, watch for them to sweep it under the rug. Maybe he can borrow the PTSD excuse or perhaps he was experiencing a diabetic episode of some sort.

“However, Sheriff Leon Lott says the CPD made a mistake in arresting Derrick.

Lott says columbia police believed Derrick did not have the authority to make an arrest. He says Derrick does have that authority.

The sheriff also disputes a suggestion in the CPD incident report that Derrick was making an advance on the woman but had been rejected. He says his deputy was trying to calm the soldier.

Police confiscated a loaded gun Derrick was carrying at the time of the incident, and his identification, badge, and bar receipt.”

I don’t know about the laws covering off-duty cops carrying guns while drinking, but as a CWP holder I’m not allowed to carry a gun into a facility that serves alcohol.

Reply
CorruptionInColumbia October 15, 2013 at 4:28 pm

In SC, an active-duty police officer can carry pretty much anywhere except inside a jail or in the hallowed halls of some sacred Federal buildings. They are not bound by the idiotic “Rob Me” signs or most restrictions imposed on CWP holders.

MOST departments however, have policies which forbid the consumption of alcohol while carrying.

A retired police officer with HR-218/LEOSA credentials may carry in places that serve alcohol if NOT CONSUMING but are bound by the idiotic “Rob Me” signs.

Hope this helps to clarify some of the issues.

It would appear that this guy “likely” violated some RCSD policies regarding carrying while consuming. Not sure if RCSD has those policies or not, but would imagine it a safe bet they do, given the size of the department.

Clearly Lott has totally misunderstood the difference between capcity/authority to do something, and circumstances which permit taking action under that authority.
Does a Federal Dist. Judge have the authority to declare me or anyone in this state mentally insance. Sure, he or she is well within their authority – they may just not have cause, evidence, jurisdiction, or basis for doing so. This cop had authority to make arrest, but….this one, at this time, under these circumstance, and for what reason? He should have had another drink or 12.

You’re acting like “law” or even morality matters. Really, are you that naive?

Even if we were going to run with the notion that this poor girl broke some law, let’s say the law was, “You must lick the boot of a drunk off duty pig.”, I doubt his mental capacity at the time was such that he was able to recite it at the time of her “arrest” let alone write a report.

I assure you that’s the reason the CPD confiscated his bar receipt. Someone in the CPD did a good job of covering their ass for an event just like this.

Anyway, there are thousands of “laws” on the books that any cop can prosecute you for any time he wants. It’s why you must kiss their asses all the time because if you simply tell them you don’t like them, they have a cornucopia of laws with which to charge you. Most citizens break several a day and don’t even know it.

Reply
CorruptionInColumbia October 15, 2013 at 5:22 pm

Confiscating the bar receipt was excellent thinking on the part of the arresting officer. He should be commended for that stroke of genius.

That said, it remains to be seen if the bar receipt will be “lost” or not, before this is over. Heavy hitters in the Lott Family are going to confer about this. With Lott saying that CPD was somehow wrong in arresting his deputy, I am curious as to what Santiago, Dan Johnson, and Lott will decide to do (or not do) with this case.

You do ascribe to the policy that law enforcement should NEVER torture suspects, right?

I notice that in the State Newspaper today more civilians are reported killed by law enforcement than other way around. Do you not see that as problematic?

Reply
CorruptionInColumbia October 15, 2013 at 5:17 pm

I am in no way taking up for this guy. What I saw in the video was disgusting to the max and I hope appropriate charges are brought (to include kidnapping, false arrest, and assault).

That said, given that most violent criminals (armed robbers, active shooters, rapists, home invaders, etc) are “civilians”, I do not see a problem with more of them being killed by cops than the other way around. This is exactly as it should be.

Off duty copys shouldn’t go out to make arrest whie they are drinking under no authority of law whatsoever, for what at the most could be a misdameanor? We don’t even have an alleged crime being committed by her. Want to ruin your week (or you next 100 plus weeks?) let me put you in cuffs and put a full Nelson on you. A couple of labrums and four suprspinatus (rotator cuffs) later, you will be really suprised how effect these 1950’s police tactics were at breaking suspects. Part of the reason they are considered police brutality.

Under the law, off duty or not … drinking and holding a woman for no reason against her will constitutes “kidnapping” …. The best thing to do with this law enforcement agency is to replace every single one of the deputies. The entire force is out of control. We The People can no longer tolerate this bullshit stuff that goes on with these swollen head son of a bitches who walk around acting like they are GOD himself. HANG THIS SHIT. This is so fucking awful. Note when he has her in cuffs and is applying a full Nelson – he is cleary attempting to inflict (and succeded wildy) a tremendou amount of pain, and I would be surprised if he didn’t tear a ligament or tendon in either or both shoulders.
NOTE: when he says “she’s not under arrest but she’s about to be.” So under what authority does he have in cuffs again while he is out off duty and out of uniform.
This is Richland’s finest? And Lott sounds like he is trying to take this from a public relations nightmare, and see if he can’t get some sort of award going for the officer that did it? WTF? But then again, its people like this that Lott and Benjamin see as the problem folks, not the gangbangers down town shooting teenagers who are minding their business.

While I am very glad he was fired, he should also be arrest. This clearly was not under the authority of law. The cuffs may belong to the RCSD, but that doesn’t make any act of violence he cares to do with it lawful nor legal. I am glad one patron was willing to film it.

If you have seen the movie “Safe Haven” where the female leads alcoholic estranged husband who is a cop comes after her, this guy reminds me of him to a T, bully, alkie, cop who likes to beat up on women, abuse his authority, misue the power of the “law,” it’s like he’s the same character.

Small consolation, I realize, but this cretin cop _has_ now been fired: http://www.addictinginfo.org/2013/10/17/off-duty-deputy-assualt/ . And let’s not ignore the good that also happened. More than a couple people – some even apparently complete strangers to the woman being assaulted – didn’t just ignore it, and some tried to directly intervene, even when the cop threatened to “arrest” them too. (And the cop had a gun; try not to judge the folks that didn’t physically charge in.) That’s the world we should all want to inhabit, where we don’t let people get away with assaulting others just because they can. To borrow a phase from the homeland security folks: if you see something, say something. Be the change, folks. :)
