U.S. Sen. Lindsey Graham (RINO-S.C.) – that fiscally liberal, war-mongering neocon whore who attacked U.S. Sen. Rand Paul last month (and again this month) for having the audacity to stand up for individual liberty – is at it again.

Graham’s latest?

Arguing that the U.S. Constitution shouldn’t apply in the (potential) prosecution of one of the Boston Marathon bombing suspects.

“They were radicalized somewhere, somehow,” Graham told Jennifer Rubin of The Washington Post. “Regardless of whether they are international or ‘homegrown,’ this is Exhibit A of why the homeland is the battlefield.”

Translation? The American criminal justice system – at least insofar as Graham is concerned – isn’t worth the paper the U.S. Bill of Rights was printed on.

Say what you want about 19-year-old Dzhokar Tsarnaev – the subject of the ongoing Boston manhunt – but he is an American citizen (as of last September).

That means whether we like it or not (or whether he deserves it or not), he has the right to remain silent, to have an attorney present with him during questioning and to have an attorney appointed to represent him in the event he cannot afford one. And that’s just the first layer of due process provided to American citizens.

It also means Graham and his buddies can’t waterboard him …

As we’ve noted previously, we have no problem with the use of “enhanced interrogation techniques” as part of an effort to obtain intelligence from enemy combattants. But not Civus Americanus. Never Civus Americancus. If they can do it to Dzhokar Tsaraev over the Boston bombing, they can do it to you over anything …

Unless you have later news, the new presiding judge in the trial ruled 18 December 2012 that Maj. Nidal Hasan does not have to shave his beard, let alone his head.

The previous judge in the case, Col. Gregory Gross, was removed by the US Court of Appeals for the Armed Forces as not being impartial. This was the judge that cited Hasan for contempt of court and had him forcibly shaved earlier in the trial.

I didn’t vote for Obama, but on military side, he is acting just like Republicans would. So I have to ask: Is there a real threat? Or are these just mean bastards out to destroy America? I lean towards real threats. We are not privy to intelligence information, b/c it puts America at risk. One must ask yourself, regardless of whether swallowed the red pill or the blue one – WHY are they doing the same thing? Why would a democrat EXPAND military action? Particularly “claimed” to be a Muslim?

It is an emotional delusion to assign conduct to any human being based on membership in a group (gender, race, party, etc.) Politicians have same goal of ruling (for our own good, of course, since they appoint themselves better equipped to know what’s best for ourselves), succumb to the same self interest temptation to beneficently rule, use the same approach. What Graham is saying is if this guy is suspected, and right now probably high ranking gov officials know right now, an affiliate of a foreign terrorist organization like al Qaeda he could be held as an enemy combatant. This is the same as Jose Padilla and Ramzi, both American citizens who were as held as enemy combatants.

The reason to hold him in a military setting is to gather intelligence — stop future bomb plots, anyone else working with them, etc. They can interrogate him for informatiom. if he is read his Miranda Rights hes told to shut up.

Which is more important right now — stopping a possible future bomb plot he may know about or preparing for his trail in 2 years?

I agree that the POS should die. Word I have from one person is that he was not in great shape when the police captured him, so hopefully, he will leave this world, soon.

That said, the stuff Lindsey and company have proposed and passed into law (such as NDAA-2012) which deny any citizen due process if they live to see trial, should scare any real American. Our founding Fathers put those safeguards into place for a reason. If we start thumbing our nose at them and making “exceptions”, we ourselves may be the next ones to be denied those protections.

It’s all a political game. Toal set the precedent for this type third world country justice in 2004. I recently heard one of Toals trolls giving a seminar on the judicial discipline system. This woman would not answer a single question in a straight forward manner about what the rules really are and what they mean. It is a joke. The point is that the American criminal justice system is in a serious time of decline.

The argument in this unique situation is on the razor’s edge especially when there is no doubt as to his guilt. But does this guy have knowledge of other planned terrorist acts?

If he survives long enough to give any information about anything, this case will affect the future “rights” of these types of terrorists and murderers ( he killed his brother according to the latest report).

If he his allowed a lawyer (especially one from the South) his defense will be the old-time standby that he was taken away from his mother’s teat too early!
