And: FITS has done some pretty low things to try to sell this site…and Marchant is just as low, if not lower…

“After a night together of dinner and drinks with other participants of the conference, Representative Haley and I returned to the hotel together,” Marchant states in the document. “We went back to her room where we had sexual intercourse and I spent the remainder of the evening. I left her room at approximately 6 a.m.”

Marchant’s affidavit was issued in response to a request from S.C. Conservatives for Truth in Politics (TIP), a group of Republican leaders that is challenging Haley on a number of different issues. It comes three days after FITS founding editor Will Folks also submitted an affidavit in response to a request from the group.

Haley continues to deny both claims – but is refusing to sign an affidavit to that affect. She has also refused to release taxpayer-funded email and phone records requested by members of the media – citing a legislative exemption.

This is all very interesting. Marchant’s admission alone is not enough to support a divorce on the ground of adultery. There will need to be some corroborating evidence which establishes motive and opportunity to do the deed. So what will come out of this is that Haley will be deposed and all of these “sources” who can place Marchant and Haley together will be important in proving adultery. Unfortunately for Will this likely will not impact his alleged affair with Haley.

No, it’s not. Even if both parties say that one party had an affair, there must be corroborating evidence. This prevents collusion, as SC is a “fault” state (as opposed to “no-fault”) for divorce, and if there are no grounds, then a couple must go through a one year separation period. To get it over more quickly than a year, some couples will collude and say there was adultery. Having corroboration prevents that type of collusion.

Wrong. Let’s just say I have first hand knowledge of this. If one party files adultery charges, and the other admits it, divorce is granted as adultery. Yes, it is one of the few ways to get around the year process, but the notion that it is not accepted as such is just incorrect. Again, on this one, I have been there/done that. If one party denies adultery, THEN evidence must be provided. And that evidence does not have to be proof of sexual encounter. Adultery, in SC, can be proved by merely being alone with a possible paramour.

So you’ve lied to get around the law? Who was the judge who “accepted it as such?” It’s not a smart move to admit to adultery, b/c that is against the law in SC. But if that’s the way you want to go about it, you can accept the poor reflection on your character, whether you are the party to the case or the attorney who advised his client to do so.
Also, Marchant’s wife remained with him after he admitted to adultery w/ Haley in a sworn affidavit, so Mrs. Marchant can not be granted a divorce on the grounds of adultery as to Nikki Haley under SC law because, by her own admission, she stayed with him for over two years after she had knowledge of the alleged affair. Thus, she condoned the conduct under the law – Nikki Haley is a non-issue in this divorce. Thus, Haley’s lawyers can use the argument that her conduct is not relevant in this case to prevent her from being deposed.

You are correct that Marchant’s wife “forgave” his adultery with Haley under SC law. She remained with him, and that voids the affair UNLESS he continues the affair after she forgave him; continues without her knowledge. And while adultery is still against the law in SC, it hasn’t been prosecuted in long time. Now, I never said I lied. I was merely telling you and others that in SC, admission of adultery is enough for divorce. Any lawyer that would advise you to lie about NOT having an adulterous affair is not worth having. You’re confusing moral issues with legal issues. If you are guilty of adultery, but “deny, deny, deny”, and judge finds you guilty, you will be hit with less than equitable distribution of property. I don’t know if you have experience in family court, but I have. And know other people who have.

I’m just an individual that stood in a courtroom before a judge. In one of the toughest counties in the state. If you’re an attorney, great. Are you a Family Court Attorney? if you are, and you are telling your clients what you have stated here, well…..
I have a friend who is a patent lawyer. Very successful. But he is not Family Court attorney and does not advise on such. And, my best friend is very good friends with one of the most prominent attornies in Columbia, and would tell you and others the same thing I’m saying. If both parties agree on the adultery, that satisfies the court. If one party disputes, then yes, evidence must be shown. And in SC, evidence does not have to prove sexual contact, just the opportunity.

Technically corroborating evidence would not be required in the rare case where adultery was admitted and the Judge determined that there was no collusion. However, this is not the norm. My personal opinion is that a lawyer should never have his client admit to adultery because it is a crime punishable by up to a year in prison (Code 16-15-70). I would never counsel my client to lie and deny adultery; however, you can simply not contest whatever your wife/husband says about adultery (assuming the judge does not require corroboration) or what a corroborating witness says about adultery. Your wife testifying you admitted to adultery is not going to subject you to criminal charges. I’ve actually taken my client and left the courtroom when we knew evidence of adultery was going to be presented.

You make some good points. However, if adultery has been charged, and your client knew it was true, he or she would be ill advised to deny it in court. Once proven, the judge will put the hammer down harder on distribution of estate. While adultery is technically still a crime in SC, do you know when it was last enforced? I can find no cases in recent memory.

Are you a Family Court attorney? are you an attorney? have you been through a Family Court case? People get horrible legal advice all the time, especially in Family Court matters. I’m merely stating from experience that your original statement is incorrect. Now, if judge suspects collusion, yes, he or she can demand proof. And of course proof is needed if charge is disputed. Probably true, but it certainly wasn’t an easy, cake walk life with the restless and detached MS. She likely hoped facilitating his dreams would make him happy as nothing else ever had and that would spill out into other aspects of their lives. This is the absolute truth. The Salt Lake City thing is a rouse. The Marchant/Haley affair lasted months. It went on in Columbia, Charleston, and Atlanta. Many people know about it.
