Nullify Obamacare? Okay …

S.C. Rep. Bill Chumley (R-Spartanburg) and State Senator Lee Bright (R-Spartanburg) are the lead sponsors of legislation which seeks to nullify Obamacare in South Carolina. And when we say nullify, we mean not only block its enforcement – we mean arrest and imprisonment for any federal or state official who attempts to enforce it.

Under the legislation, Obamacare “is invalid in this State, is not recognized by this State, is specifically rejected by this State, and is null and void and of no effect in this State.”

Furthermore, any federal employee attempting to enforce the law “is guilty of a felony and, upon conviction, must be fined not more than five thousand dollars, or imprisoned not more than five years,” while any state employee attempting to enforce the law “is guilty of a misdemeanor and, upon conviction, must be fined not more than one thousand dollars or imprisoned not more than two years.”

Wowzas, right? These guys aren’t playing around … which is precisely the impression they’re going for.

So … do we have a problem with this ultimately symbolic stand against U.S. President Barack Obama’s socialized medicine monstrosity? Of course not … however we want to make sure every South Carolina lawmaker who supports this legislation also votes against the Medicaid expansion associated with Obamacare.

That’s where the rubber meets the road with regard to this abomination … not the “nullification circus.” The U.S. Supreme Court has ruled South Carolina can reject most of the new spending associated with this law – and while we have no problem with the nullification solution, it cannot be adopted at the expense of rejecting this Medicaid money.

To grandstand against Obamacare on the one hand while profiting from it on the other would be astoundingly hypocritical … even by S.C. political standards … although as we’ve seen in years past such hypocrisy is par for the course among South Carolina “Republicans.”

Don’t get us wrong … as government at all levels veers further to the left, we’re going to be encouraging more radical measures to protect liberty, property and (what’s left of) prosperity in this nation . And that includes supporting legislation like the nullification bill sponsored by Chumley and Bright. But lawmakers cannot reject Obamacare on the one hand and take its money on the other …

Difference does not mean much in SC, where ‘felonies’ have to be specified in state law. We at one time had “misdemeanors” in the old narcotic act which carried 20 year sentences. Still some long “misdemeanor” sentences scattered throughout the SC Code.

Fed law is nice and neat: “Felony” is any crime for which one MAY be sentenced to “more than one year” for committing (actual sentence may be less than a year, but if the crime CARRIES the sentence of more than one year, it’s automatically a felony). A “misdemeanor” under Federal law is any crime which carries a sentence of a year or less. Hence, the sentence of “a year and a day” to create the appearance of a felony, used in many states other than SC.

Ask John Jenrette about the difference.

Now that the site’s constitutional scholar, Big T, has weighed in, we now know that any state can nullify any federal law it doesn’t like.

I can’t see any problems with this constitutional arrangement. Does this mean we can stop pay federal taxes if it passes the state legislature?

I can’t see anything wrong with your plan Big T. I think SC should pass this law, and raise a volunteer police force to enforce it. You have gun’s right? You would be willing to take your guns into federal office buildings and arrest federal employees, right? I am sure Mr. Chumley and Mr. Bright will be there with their guns to back you up.

With the Tea Party providing the gun power, there should be little cost to the taxpayers of SC. So, please proceed. I am anxious to see how this works out. You will need to identify yourself however, so that I can see if you are truly willing to follow through with your promise or you are just another blow hard.

Hasn’t SC been here before? Many years ago a great Southerner, and SC native, said:
“Nullification means insurrection and war; and the other states have a right to put it down.” I’m not certain the other states would care so much now. Keep in mind SC receives $2.13 in benefits for every $1.00 paid in federal taxes (based on 2010 IRS data). The other states might just say — “Let ’em go.” How does nullification help us?

Lot’s of unanswered questions there.

That being said, Andrew Jackson made a mistake: it is the Feds that initiate putting down nullification.

Even further, him being a “native” is suspect:

“But he may have claimed to be a South Carolinian because the state was considering nullification of the Tariff of 1824, which Jackson opposed. In the mid-1850s, second-hand evidence indicated that he may have been born at a different uncle’s home in North Carolina.” via Wiki.

The notion of state sovereignty or this idea that the United States is a voluntary union,or the states have rights via the 10th amendment really needs to be dispensed with. It has no accuracy as to the reality of things.

It would be a lot easier if we just went ahead and did away with all the borders of all the states and just called the country “America” instead of pretending the state boundries have any kind of lasting power. Watching any attempts to retain such right slowly erode away over time is nothing but a waste of time/money anyway.

Onward and upward to bigger things I say!
